ACTION TAKEN The Whatcom County Council adopted the following at its March 31, 2026 meeting: ORDINANCE AMENDING WHATCOM COUNTY CODE CHAPTER 2.56, DEFENSE AND INDEMNIFICATION OF EMPLOYEES, TO INCLUDE RESERVATION OF RIGHTS AND REIMBURSEMENT (AB2026-233): This ordinance adds a reimbursement and reservation of rights provision to Whatcom County Code Chapter 2.56 to allow the county to deny indemnification or seek reimbursement if a final judicial determination establishes that an officer, agent, official, or employee acted outside the scope of employment, or acted with malice, fraud, corruption, or bad faith. Ordinance introduced March 17, 2026. Public documents are available for review weekdays from 8:30 a.m. to 4:30 p.m. in the Council Office, 311 Grand Avenue, Suite 105, Bellingham, and at whatcomcounty.us/council. View meeting schedules, agendas, minutes, videos, documents and archives at whatcom.legistar.com. The Council is currently holding hybrid meetings, which can be attended either in person or remotely.
