204500ORDINANCE NO. 121AN ORDINANCE OF NEZ PERCE COUNTY ENACTING TITLE 111 CITY OF GENESEE AREA OF IMPACT AGREEMENT, AND FURTHER PROVIDING FOR AN EFFECTIVE DATE.BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF NEZ PERCE COUNTY, IDAHO:SECTION 1: AREA - This Agreement shall affect the unincorporated area of Nez Perce County within the following description: The northeast ¼ of Section 22 lying east of the east right of way of United States Highway 95; the north ½ of Section 23; and the west ½ of the northwest ¼ of Section 24, Township 37, Range 5 west of the Boise Meridian, Nez Perce County, Idaho, and as depicted on the attached map pursuant to the provisions of Idaho Code §67-6526.SECTION 2: DEFINITIONS – Adopting the definitions of terms used in the agreement.SECTION 3: GOVERNING PLAN AND ORDINANCES – Adopting Nez Perce County's Land Development Code and Comprehensive Plan for the Area of Impact.SECTION 4: ADMINISTRATION OF THE AREA OF IMPACT – The County shall administer the applicable Ordinances and Resolutions for the Area of Impact. Adopting the County fee schedule. The County shall notify the City of Genesee of land use applications and strongly weigh their comments. The County shall perform inspections and issue certificates of occupancy. The County shall address complaints. Applicants shall submit land use applications in conjunction with annexation requests to the City of Genesee.SECTION 5: APPEALS PROCESS – City recommendations offered are not final determinations. Appeals from County actions are governed by the relevant County Ordinances and Idaho Rules of Civil Procedure.SECTION 6: ENFORCEMENT - The Planning and Building Department and/or the County Prosecuting Attorney may take legal action to enforce land use regulations within the Area.SECTION 7: RENEGOTIATION – The Agreement may be renegotiated at any time upon written request by either party, but must be reviewed at least every 5 years.SECTION 8: EFFECTIVE DATE - This Ordinance shall take full force upon its approval, passage, and publication in one (1) edition of the Lewiston Morning Tribune, a newspaper of general circulation within Nez Perce County, Idaho.Regularly passed, approved, and adopted by the Board of Commissioners of the County of Nez Perce, state of Idaho, on this 13th day of April, 2026, nunc pro tunc to September 15, 2025.&tab;BOARD OF COUNTY COMMISSIONERS&tab;Nez Perce County, Idaho&tab;/s/ JOSEPH B.
