NOTICE OF APPLICATION FOR AMENDMENT TO APPROVED SITE PLAN Notice of Application Date: February 20, 2026 The City of Black Diamond has received the following applications that may be of interest to you. The applications and any related documents are available for public review by contacting the City's project manager. Application Date: December 5, 2025 Complete Application Date: February 6, 2026 Owner: Weston Butt / Third Avenue Development LLC Applicant: Jacob Miller / Barghausen Consulting Engineers, LLC Project Name: Retail South Site Plan Amendment Application Number: PLN25-0109 (Site Plan Review); PLN25-0110 (SEPA) Zoning: Community Commercial (CC) Location: West side of Third Avenue (SR 169) to the north of Black Diamond Ravensdale Road at 31231 Third Avenue (SR169); tax parcel number 112106-9032. Project Description: The applicant is requesting an amendment to an approved Site Plan (PLN19-0077), originally approved on December 28, 2020, for an approximately 4.82-acre site. The proposed amendment would modify the proposed layout of two buildings on the currently undeveloped portion of the site and include the construction of an approximately 10,239-square-foot daycare building with an associated playground area, and an approximately 11,374-square-foot retail building. Environmental Documents: The environmental impacts for this proposal are being assessed with an associated SEPA Environmental Review under City File Number PLN25-0110. The City issued a MDNS for the approved Retail South Site Plan (Site Plan File Number PLN19-0077; SEPA File Number PLN19-0078), in February 2020. A subsequent 14-day public comment period will be provided once the City has prepared a threshold determination. Environmental documents available for review include a site plan, supplemental traffic assessment with parking circulation plan, landscape plan, photometric plan, coal mine hazard assessment, stormwater management plan, utilities plan and SEPA checklist. Requested Approval: Site Plan Review Amendment and Environmental Threshold Determination Applicable Development Regulations: Applications for Site Plan Review are processed as Type 2, administrative land use reviews pursuant to Black Diamond Municipal Code (BDMC) Chapter 18.08 and 18.16. Written Comments: There is a 14-day public comment period with this Notice of Application. You are invited to submit written comments, request a copy of the decision when it becomes available, and be made aware of any appeal rights during the public comment period by contacting the staff contact listed below.
