Public hearing on proposed amendment of District Rule 1304 scheduled for March 23, 2026.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN that the Governing Board of the Mojave Desert Air Quality Management District (MDAQMD) will conduct a public hearing on 3/23/2026 at 10:00 A.M. to consider the proposed amendment of District Rule 1304 - New Source Review Emissions Calculations.
SAID HEARING will be conducted in the Governing Board Chambers located at the MDAQMD offices 14306 Park Avenue, Victorville, CA 92392-2310 where all interested persons may be present and be heard. Copies of the proposed adoption, amendments, and the Staff Reports are on file and may be obtained from the Clerk of the Board at the MDAQMD Offices or from the MDAQMD’s website. Written comments may be submitted to Brad Poiriez, Executive Director/APCO at the above office address. Written comments should be received no later than 3/19/2026 to be considered. The proposed amendment will provide a sunset clause for a provision of District Rule 1304 - New Source Review Emissions Calculations, specifically subsection 1304(C)(2)(d), that allowed existing major facilities to utilize, under limited circumstances, previously offset potential to emit in a subsequent New Source Review action. This sunset clause is the result of a negotiated settlement regarding lawsuits that challenged certain actions of United States Environmental Protection Agency (USEPA) in relation to the MDAQMD’s New Source Review rules.
Pursuant to the California Environmental Quality Act (CEQA) the MDAQMD has determined that a Categorical Exemption (Class 8 – 14 Cal. Code Reg §15308) applies and has prepared a Notice of Exemption for this action.The Press-EnterprisePublished: 2/17/26
