Summary of Ordinance No. CS512 per Government Code �36933(c) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 8 OF THE CARLSBAD MUNICIPAL CODE BY ADDING CHAPTER 8.15 ADMINISTRATIVE PENALTIES FOR FIREWORKS VIOLATIONS The proposed ordinance amends Carlsbad Municipal Code Title 8 by adding Chapter 8.15 Administrative Penalties for Fireworks Violations. The proposed ordinance: Establishes a clear administrative citation process with administrative penalties of $1,000 per violation and a maximum administrative penalty balance of $10,000 per day ; Authorizes designated personnel to issue administrative citations and links to existing cost recovery provisions in the Carlsbad Municipal Code, such as cost recovery for certain emergency responses; and Provides due process protection through an administrative appeal process.
