ORDINANCE NO. 26-425.1 AN ORDINANCE AMENDING CONCORD MUNICIPAL CODE, TITLE 18 (DEVELOPMENT CODE), CHAPTERS 18.15 (ZONING DISTRICTS AND ZONING MAP), 18.25 (DEVELOPMENT AND LAND USE APPROVALS), 18.30 (RESIDENTIAL DISTRICTS), 18.40 (OFFICE AND COMMERCIAL DISTRICTS), AND 18.410 (ZONING CLEARANCE); ADDING CHAPTER 18.120 (AFFIRMATIVELY FURTHERING FAIR HOUSING OVERLAY DISTRICT); AND REZONING APPROXIMATELY 28 ACRES TO APPLY THE AFFIRMATIVELY FURTHERING FAIR HOUSING OVERLAY DISTRICT (PL25166 MC) PLEASE TAKE NOTICE that on March 10, 2026, in the Concord City Council Chamber, located at 1950 Parkside Drive, Concord, CA, at 6:30 p.m., or as soon thereafter as the matter may be heard, the Concord City Council will consider adoption of the above-entitled Ordinance. Summary: Objective 8.6 of the 2023-2031 Housing Element of the City's General Plan, requires the City to rezone at least 20 acres in moderate- and high-resource areas to allow a residential density of at least 60 dwelling units per acre to accommodate at least 1,000 housing units. The Ordinance amends various sections of the Concord Municipal Code (CMC) to create housing overlay zoning allowing higher-density residential uses in addition to existing uses at five sites (Kmart, Clayton Faire, Palm Lake Apartments, 5390 Myrtle, and 1539 Kirker Pass).
