CITY OF SAN JUAN CAPISTRANOADOPTION OF AN ORDINANCE Notice is hereby given that on April 7, 2026, the City Council adopted Ordinance 1133 entitled: AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING REZONE (RZ) 25-002 TO CHANGE THE ZONING OF THE DEVELOPED PROPERTIES LOCATED AT 30700 (SWALLOWS CREEK) AND 30800 (FLUIDMASTER, INC) RANCHO VIEJO ROAD FROM INDUSTRIAL PARK TO COMMERCIAL MANUFACTURING AND CHANGE THE ZONING OF AN ADJACENT VACANT PROPERTY (APN: 650-112-07) FROM INDUSTRIAL PARK TO GENERAL OPEN SPACE, AND A FINDING THAT SAID ACTION IS NOT A “PROJECT” AS DEFINED UNDER STATE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) GUIDELINES SECTION 15060(c)(3), AND IF THE ACTION WERE CONSIDERED A “PROJECT”, IT WOULD BE EXEMPT PER STATE CEQA GUIDELINES SECTIONS 15061(b)(3) AND 15320 (APPLICANT: DEDEAUX PROPERTIES, LLC). This ordinance will approves Rezone 25-002, changing the zoning of the developed properties located at 30700 (Swallows Creek) and 30800 (Fluidmaster, Inc.) Rancho Viejo Road from Industrial Park to Commercial Manufacturing and change the zoning of an adjacent vacant property (APN: 650-112-07) from Industrial Park to General Open Space. The Rezone is intended to support tenant attraction and operational flexibility for the recently completed Swallows Creek warehouse development. The adjacent property to the south, located at 30800 Rancho Viejo Road and owned by Fluidmaster, Inc., is also currently zoned IP. To maintain zoning consistency between the two properties, the Fluidmaster site is also proposed to be rezoned from IP to CM. Additionally, a vacant parcel owned by the Applicant located across Rancho Viejo Road (APN: 650-112-07) is proposed to be rezoned from IP to General Open Space (GOS) to align the parcel’s zoning designation with its existing General Plan Land Use designation of GOS. Both the Applicant and Fluidmaster support the collective Rezone. On December 2, 2025, the City Council initiated a study of the proposed Rezone. Staff has completed the study and believes all findings can be made for proposed Rezone 25-002. On February 11, 2026, the Planning Commission considered the Rezone and adopted a resolution recommending that the City Council approve Rezone 25-002.
