CITY OF SAN JUAN CAPISTRANOINTRODUCTION OF AN ORDINANCE Notice is hereby given that on April 21, 2026, the City Council will adopt an ordinance entitled: AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CODE AMENDMENT (CA) 21-006 TO AMEND MUNICIPAL CODE SECTIONS 1-8.01, 9-3.301, 9-3.305, 9-3.505, 9-3.533, 9-3.535, 9-3.550, 9-5.103, AND TITLE 9, APPENDIX A: DEFINITIONS, TO COMPLY WITH STATE HOUSING REQUIREMENTS AND TO REMOVE BARRIERS TO PROVIDING HOUSING, AS IDENTIFIED TO BE ADDRESS WITHIN THE 2021 – 2029 CERTIFIED HOUSING ELEMENT; AND FINDING THAT NO FURTHER ENVIRONMENTAL REVIEW IS NECESSARY PURSUANT TO SECTION 15162 OF THE STATE CEQA GUIDELINES. Every eight years local jurisdictions in California are required by state law to update their General Plan Housing Element to accommodate the anticipated population growth, modify processes to remove barriers to the development of housing, identify incentives to encourage the development of affordable housing, and comply with state housing laws. On July 20, 2021, the City Council initiated General Plan Amendment (GPA) 21-003, Rezone (RZ) 21-004 and Code Amendment (CA) 21-006 to: 1) update the City’s General Plan Housing Element; 2) amend the City’s Zoning Map and General Plan Land Use Map to implement the updated Housing Element; and 3) amend the City’s Land Use Code to ensure the code is consistent with the updated Housing Element and state housing law. In August 2022, the City Council adopted an updated Housing Element (for the 2021 – 2029 planning period), which identified multiple strategies and necessary code amendments to comply with state law, remove housing development barriers, and incentivize affordable housing development. The City’s strategies were accepted by the State and the City’s updated Housing Element was subsequently certified by the State in September 2022. This ordinance will implement actions, programs and housing strategies that the City committed to in its State-certified Housing Element to ensure the City’s code is consistent with state housing law.
