NOTICE OF PUBLIC HEARING BEFORE THE BOARD OF SUPERVISORS OF RIVERSIDE COUNTY NOTICE IS HEREBY GIVEN that a public hearing at which all interested persons will be heard, will be held before the Board of Supervisors of Riverside County, California, on the 1st Floor Board Chambers, County Administrative Center, 4080 Lemon Street, Riverside, on Tuesday, May 12, 2026 at 9:30 a.m., or as soon as possible thereafter, to consider the following: RESOLUTION NO. 2026-030 A RESOLUTION OF THE COUNTY OF RIVERSIDE ADOPTING SOLID WASTE COLLECTION RATES IN THE UNINCORPORATED AREAS FOR FY 2026-2027 WHEREAS, California Government Code section 25827 authorizes the Board of Supervisors to prescribe terms and conditions by Resolution for the collection of solid waste in the unincorporated areas of Riverside County; and WHEREAS, California Public Resources Code section 40059 authorizes the County of Riverside to determine all aspects of solid waste handling which are of local concern, including, but not limited to, whether the services are to be provided by wholly exclusive franchise, contract, permit, or otherwise, and the charges and fees for such service; and WHEREAS, Riverside County Ordinance No. 745 (as amended through 745.4) established that a Solid Waste Hauler, duly franchised by the County of Riverside, (“Franchisee”) shall be entitled to payment for services rendered in the amounts as specified in a Resolution adopted by the Board of Supervisors; and WHEREAS, on September 10, 2024, following a duly noticed public hearing, the Board of Supervisors approved the First Amended and Restated Franchise Agreements (“Franchise Agreements”) with its four exclusive Franchisees, Waste Management Collection and Recycling, Inc., CR&R Incorporated, Desert Valley Disposal, Inc., and Burrtec Waste & Recycling Services, LLC, to include provisions for new service and compliance programs to meet the organic waste reduction goals mandated by the State pursuant to Senate Bill No. 1383 for solid waste collection services in the unincorporated areas of the County; and WHEREAS, the Franchise Agreements provide provisions for an annual rate adjustment process for a period, including any applicable adjustments for inflation based on changes in the Consumer Price Index (“CPI”), with no less than thirty (30) days’ notice provided, pursuant to Government Code sections 53755 and 53756; and WHEREAS, on or before March 15, 2026, the Franchisees submitted rate applications to the County pursuant to the terms of the Franchise Agreements which contained the annual rate adjustment calculations, an updated rate schedule, and any other information necessary to support the proposed rate adjustments to the Solid WHEREAS, the Department of Environmental Health has reviewed the proposed rate adjustment submitted by each Franchisee and recommends the Board of Supervisors approve the proposed Solid Waste Collection Rates for Fiscal Year 2026-2027 as adjusted for inflation, effective on July 1, 2026; and WHEREAS, the Board of Supervisors acknowledges the need for the CPI increase of the Solid Waste Collection Rates to address cost increases in providing the mandated additional services and oversight in compliance with SB 1383. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED that the Board of Supervisors of the County of Riverside, State of California (the “Board”), in regular session assembled on May 12, 2026, at 9:30 a.m. or soon thereafter, in the meeting room of the Board of Supervisors located on the 1st floor of the County Administrative Center, 4080 Lemon Street, Riverside, California, based upon review of the evidence and information presented on the matter, and upon closing of the public hearing, hereby finds and declares as follows: 1. That the foregoing Recitals are true and correct and are incorporated herein by this reference. 2. The Solid Waste Collection Rates for Fiscal Year 2026-2027 shall be adjusted for inflation based on the CPI of 3.2% to the service component of the Franchisee’s fees in the unincorporated areas of Riverside County. 3. Franchisees shall provide notice of any adjustment to rates in their respective service areas: a. Waste Management Collection and Recycling, Inc. in Franchise Areas 1, 3, and 4 b. CR&R Incorporated in Franchise Areas 5, 6, 7, 9, and 13 c. Desert Valley Disposal, Inc. in Franchise Area 10 d. Burrtec Waste & Recycling Services, LLC in Franchise Area 12. 4. The Board adopts the Solid Waste Collection Rates for Fiscal Year 2026-2027 to take effect on July 1, 2026. The previous rates shall be superseded upon the effective date of the newly adopted rates. 5. This Resolution shall take effect immediately upon its adoption.
