Early Notice and Public Review of a Proposed
Activity in a 100-Year Floodplain
To: All interested Agencies, Groups, and Individuals
This is to give notice that Florida Housing Finance Corporation (FHFC), as the Responsible Entity under 24 CFR Part 58, has determined that the following proposed action, funded under the U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME), is located in a 100-year floodplain, and FHFC will be identifying and evaluating practicable alternatives to locating the action within the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988 and/or Executive Order 11990, in accordance with HUD
regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The proposed project, Sovereign at Harbor West, is located at 145 & 155 Parade Circle, Rotunda West, Unincorporated Charlotte County, FL and is for the construction of an affordable multi-family rental development with 32 living units, family demographic, located within a 100-year flood zone.
The proposed project area totals 3.40 acres. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) #12015C0194G, dated December 15, 2022, 0.09 acres of the project site is located within a Special Flood Hazard Area (Zone AE), designated as a 100-year floodplain. The remaining 3.31 acres of the site are located in Zone X, outside the 100-year floodplain. The proposed development has been designed to minimize impacts to the floodplain, with the residential buildings positioned outside the 100-year floodplain boundaries. No portion of the stormwater management system, buildings, or parking lot will encroach into the 100-year floodplain. Areas within flood zones can provide potential benefits such as fish and wildlife habitat protection, natural flood and erosion control, surface water quality maintenance, groundwater recharge, and biological productivity.
There are three primary purposes for this notice. First, people who may be affected by activities in the floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain, alternative methods to serve the same project purpose, and methods to minimize and mitigate project impacts on the floodplain. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about the floodplain can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in the floodplain, it must inform those who may be put at greater or continued risk.
