NOTICE OF PROPOSED RULE: The Southwest Florida Water Management District is proposing to amend the following rules: 40D-2.321 Duration of Permits Chapter 2024-180, Laws of Florida, required water management districts to develop rules promoting reclaimed water use and encouraging quantifiable potable water offsets with specific requirements for such rules. The rule amendments are to allow for a water use permit duration up to 30 years and extensions up to 10 years if a water supply development or water resource development project using reclaimed water meets certain conditions. The District recently adopted rule amendments to comply with this statutory mandate. However, the District has discovered errors in its amendments to Rule 40D-2.321, F.A.C. This rulemaking is to correct those errors. The Notice of Proposed Rulemaking appeared in the Florida Administrative Register, Vol. 52, No. 78, on April 22, 2026.
