Lebanon Township NOTICE OF PENDING ORDINANCE NO. 03-2026 ORDINANCE REPEALING AND REPLACING CHAPTER 400, ARTICLE III OF THE REVISED GENERAL ORDINANCES ENTITLED "GENERAL PROVISIONS" AND CHAPTER 400, ARTICLE VIII, ENTITLED "AFFORDABLE HOUSING PRODUCTION" TO ADDRESS THE REQUIREMENTS OF THE FAIR HOUSING ACT (FHA) AND THE UNIFORM HOUSING AFFORDABILITY CONTROLS (UHAC) REGARDING COMPLIANCE WITH THE TOWNSHIP'S AFFORDABLE HOUSING OBLIGATIONS PLEASE TAKE NOTICE that Ordinance No. 03-2026 was introduced and passed on first reading by the Lebanon Township Committee at a regular meeting held on February 11, 2026. Said ordinance will be considered for final adoption on second reading by the Township Committee following a public hearing on March 11, 2026, at 7:00pm at the Township Municipal Building, 530 West Hill Road, Glen Gardner, NJ 08826 at which time all interested persons will be given an opportunity to comment on this Ordinance during the public hearing. SUMMARY STATEMENT: the Township of Lebanon filed a Declaratory Judgment Action in the Superior Court of New Jersey, Hunterdon County, captioned IMO Township of Lebanon, Docket No HNT-L-46-25 pursuant to N.J.S.A. 52:27D-304.2, -304.3, and -304.1(f)(1)(c) of the New Jersey Fair Housing Act, N.J.S.A. 52:27D- 301, et seq. and in accordance with Section II.A of Administrative Directive #14-24 of the Affordable Housing Dispute Resolution Program, seeking a certification of compliance with the FHA. The Township entered into a Consent Order with Fair Share Housing Center ("FSHC") dated December 10, 2025 approving the Township's Fourth Round Housing Element and Fair Share Plan ("HEFSP") and granting the Township a Compliance Certification. The Consent Order and adoption of the HEFSP require certain changes to the Township's ordinances to address compliance issues.
