NOTICE OF HEARING
City of Burlington Joint Land Use Board
PLEASE TAKE NOTICE that upon the application of Higherbreed NJ LLC ("Applicant") the City of Burlington Joint Land Use Board shall conduct a public hearing on Wednesday, March 25, 2026, commencingat 7:00 p.m., or as soon thereafter as the matter may be reached, at The City of Burlington Municipal Building, Council Chambers, 525 High Street, Burlington, NJ 08016, to consider the Applicant's request for Preliminary and Final Major Site Plan and Variance Approval to use the property located at 1021 and 1031 E. Route 130 S, Burlington, NJ, more particularly identified as block 227, lots 4 and 4.03 on the official tax map of Burlington as a Class 5 Cannabis Retail business (the "Property").
Applicant seeks D(3) variance approval to use the Property as a Class 5 Cannabis Retail business. The Property is located in the Highway Corridor ("HC-2") Zoning District, where Class 5 Cannabis Retail businesses are a permitted conditional use. Applicant requires D(3) variance approval because the Applicant cannot comply with the following condition as laid out in §207-90(L)(9), which requires:
An enhanced setback and buffer/screen shall be provided along existing residential zone districts and residential uses. The minimum setback shall be 50 feet. The buffer/screen width of 25 feet within the setback shall include enhanced screening including fencing and additional landscape buffering materials and designs as deemed appropriate by the Land Use Board.
The Applicant proposes a landscape buffer of 13.45 feet, where 25 feet is required.
