Application for permission to resign from the New York bar for nondisciplinary reasons under 22 NYCRR § 1240.22(a).
Summary
The Appellate Division, Third Department granted attorney Jacob Timothy English’s application to resign from the New York bar for nondisciplinary reasons. The court reviewed English’s sworn affidavit and the Attorney Grievance Committee’s response, found him eligible under the court’s rules, accepted his nondisciplinary resignation, struck his name from the roll, and ordered that he cease practicing or holding himself out as an attorney in New York and surrender any Attorney Secure Pass within 30 days.
Issues Decided
- Whether the attorney was eligible to resign from the New York bar for nondisciplinary reasons under the Rules for Attorney Disciplinary Matters (22 NYCRR § 1240.22).
- Whether the Attorney Grievance Committee opposed the resignation and whether the court should accept the resignation and strike the attorney from the roll.
Court's Reasoning
The court reviewed English's sworn affidavit and the Attorney Grievance Committee's correspondence, which indicated no opposition. Applying the rule that permits acceptance of nondisciplinary resignations when eligibility is shown, the court determined English met the criteria in 22 NYCRR § 1240.22 and therefore accepted the resignation. As a result, the court ordered removal from the roll and attendant restrictions to prevent the practice or representation as an attorney in New York.
