Application for permission to resign from the New York bar for nondisciplinary reasons under 22 NYCRR § 1240.22

Summary

The Appellate Division, Third Department granted attorney Jonathan R. Flora's application to resign from the New York bar for nondisciplinary reasons. The Court reviewed Flora's sworn affidavit and the Attorney Grievance Committee's statement that it did not oppose the application, found him eligible under the court's disciplinary rules, accepted the resignation, struck his name from the roll, and imposed the usual prohibitions against practicing or holding out as an attorney in New York. Flora must surrender any Attorney Secure Pass within 30 days.

Issues Decided

  • Whether the attorney was eligible to resign from the New York bar for nondisciplinary reasons under the court's rules
  • Whether the Attorney Grievance Committee opposed the resignation
  • What immediate administrative and practice restrictions should follow acceptance of a nondisciplinary resignation

Court's Reasoning

The Court relied on Flora's sworn affidavit and the Attorney Grievance Committee's written response indicating no opposition, and determined that Flora met the eligibility criteria for nondisciplinary resignation under the Rules for Attorney Disciplinary Matters. Because the statutory and rule-based prerequisites were satisfied, the Court accepted the resignation, struck his name from the roll, and imposed the routine prohibitions on practice and representation in New York to effectuate the resignation.
