Application for permission to resign from the New York bar for nondisciplinary reasons under Rules for Attorney Disciplinary Matters
Summary
The Appellate Division, Third Department granted Daniel Isaac Papermaster's application to resign from the New York bar for nondisciplinary reasons and accepted his resignation. The court reviewed Papermaster's sworn affidavit and the Attorney Grievance Committee's non-opposition, determined he was eligible under the court rules, struck his name from the roll of attorneys, and ordered that he cease practicing law in New York and surrender any Attorney Secure Pass within 30 days. The resignation is effective immediately and remains until further court order.
Issues Decided
- Whether the attorney was eligible to resign from the New York bar for nondisciplinary reasons under 22 NYCRR § 1240.22
- Whether the Attorney Grievance Committee's non-opposition supports acceptance of the nondisciplinary resignation
Court's Reasoning
The court relied on Papermaster's sworn affidavit and the AGC's correspondence indicating no opposition, and concluded he met the eligibility requirements for a nondisciplinary resignation under the applicable rules. Because the resignation was voluntary and not disciplinary, the court accepted it and imposed the standard consequences: removing his name from the roll, prohibiting practice in New York, and requiring surrender of his Attorney Secure Pass.
