LIVINGSTON COUNTY LEGAL NOTICE NOTICE OF ELECTION Part Town of Avon Fire District Town of Part Town of Avon, Livingston County, New York NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Fire Commissioners, a special election of the qualified voters of the Part Town of Avon Firehouse at 1615 West Henrietta Road, Avon, New York , Livingston County, New York, on the 16th day of March, 2026, between the hours of 6:00 p.m. and 9:00 p.m. to vote upon the following Resolution: WHEREAS, the Part Town of Avon Fire District (the "Fire District") previously acquired a certain 2005 Pierce aerial fire apparatus (the "Fire Apparatus") which has been owned and operated by the Part Town of Avon Fire District for the purpose of fire suppression and for otherwise meeting the uses and purposes of the Fire District, and WHEREAS, it is no longer necessary for the Part Town of Avon Fire District to retain such Fire Apparatus to achieve the objectives of the Fire District, NOW, THEREFORE, BE IT RESOLVED, that the Board of Fire Commissioners of the Part Town of Avon Fire District, does hereby determine that the Fire Apparatus is no longer necessary for any of its uses or purposes and hereby declares the Fire Apparatus to be surplus, subject to mandatory referendum; and it is further RESOLVED, that should the referendum be approved declaring the Fire Apparatus surplus, that it be that it be disposed of in a manner acceptable to the Board of Fire Commissioners as it may determine in its sole discretion including being advertised for bid, to be sold to the highest responsible bidder, on an “as is, where is, how is” basis; that the Board of Fire Commissioners shall reserve the right to reject any and all bids submitted; and that the sale be made without warranty, representation or guarantee and upon such further terms or conditions as in the best interests of the Fire District as determined by the Board of Fire Commissioners, and it is further RESOLVED, that this resolution is subject to a mandatory referendum as provided by Sections 176(23) and 179 of the Town Law, and such referendum shall appear in substantially the following form: “SHALL THE RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE PART TOWN OF AVON FIRE DISTRICT, LIVINGSTON COUNTY, NEW YORK (THE “DISTRICT”), DECLARING THE 2005 PIERCE AERIAL FIRE APPARATUS SURPLUS AND NO LONGER NECESSARY FOR THE USE AND PURPOSES OF THE FIRE DISTRICT AND THE SAME BE SOLD IN A MANNER DETERMINED IN THE SOLE DISCRETION OF THE BOARD OF FIRE COMMISSIONERS AND UPON SUCH FURTHER TERMS OR CONDITIONS AS MAY BE IN THE BEST INTERESTS OF THE FIRE DISTRICT AS DETERMINED BY THE BOARD OF FIRE COMMISSIONERS, BE APPROVED?” and it is further RESOLVED, that p ursuant to Sections 176(23) and 179 of the Town Law , this Resolution shall be subject to a mandatory referendum, to be held at a special election on April 23, 2026 in the manner prescribed by Sections 176(23) and 179 of the Town law of the State of New York. This Resolution shall not take effect until approved by the affirmative vote of a majority of the duly qualified voters of the District voting on such proposition. As soon as reasonably possible after the date that this Resolution takes effect, the Secretary of the District is hereby authorized and directed to cause a copy of such Resolution to be published in full in the Livingston County News, which is the designated official newspaper of the District for such purposes, together with such other notices as may be required by such law. The polls will be open for the purpose of voting during the aforesaid hours, and the ballot will be in substantially the following form, to wit: PROPOSITION NO. 1 “SHALL THE RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE PART TOWN OF AVON FIRE DISTRICT, LIVINGSTON COUNTY, NEW YORK (THE “DISTRICT”), DECLARING THE 2005 PIERCE AERIAL FIRE APPARATUS SURPLUS AND NO LONGER NECESSARY FOR THE USE AND PURPOSES OF THE FIRE DISTRICT AND THE SAME BE SOLD IN A MANNER DETERMINED IN THE SOLE DISCRETION OF THE BOARD OF FIRE COMMISSIONERS AND UPON SUCH FURTHER TERMS OR CONDITIONS AS MAY BE IN THE BEST INTERESTS OF THE FIRE DISTRICT AS DETERMINED BY THE BOARD OF FIRE COMMISSIONERS, BE APPROVED?” Those who are qualified to vote on the aforesaid proposition are qualified voters who shall have resided in said Fire District for thirty days next preceding such election.
