LEGAL NOTICE RESOLUTION #2026-011 TOWN OF BETHLEHEM RESOLUTION AND PUBLIC NOTICE NOTICE IS HEREBY GIVEN that the Town Board of the Town of Bethlehem in the County of Albany, State of New York has on the 25th day of February 2026, duly adopted, subject to a permissive referendum, a resolution as follows: WHEREAS, the Town Board of the Town of Bethlehem has determined that it is in the public interest of the Town to construct a new playground at North Bethlehem Park to replace the old playground that reached its usable lifespan; and WHEREAS, an important focus for this playground will be accessibility, inclusion, and intergenerational play; and WHEREAS, an important component to the new playground will be a rubberized surface; and WHEREAS, new site amenities will also be included in the scope of the project; and, WHEREAS, this project has been identified in the 5-year capital plan budget; and, WHEREAS, in recognition of these needs, funds for such purposes are in the General Fund Capital Reserve Account; and, NOW, THEREFORE, BE IT RESOLVED, that it is in the public interest to complete the project as described above; and BE IT FURTHER RESOLVED, that the Town Board authorizes the expenditure of the General Fund Capital Reserve moneys to fund this project up to a maximum amount of $300,000 and, BE IT FURTHER RESOLVED, that the Town Comptroller is authorized to expend from the General Fund Capital Reserve account the funds necessary up to $300,000 in said fund, and this resolution shall be subject to a permissive referendum, as permitted by law; and, BE IT FURTHER RESOLVED, That the Supervisor is hereby authorized to execute the expenditure on behalf of the Town of Bethlehem. The motion to adopt the resolution was made by Councilmember Schnurr, was seconded by Councilmember Cunningham and duly adopted by the following vote: AYES: Supervisor VanLuven, Councilmember Becker, Councilmember Cunningham, Councilmember DeCancio and Councilmember Schnurr NOES: none ABSENT: none DATED: February 25, 2026
