Public notice zoning board Village of Mount Kisco PUBLIC NOTICE PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Village/Town of Mount Kisco, New York will hold a Public Hearing on the 14 day of APRIL 2026 at the Municipal Building, Mount Kisco,New York, beginning at 7:00 PM pursuant to the Zoning Ordinance on the Appeal of H. HURTADO 520 LEXINGTON AVENUE - MT. KISCO, NY from the decision Peter J. Miley, Building Inspector, dated MARCH 30, 2026 denying the application dated to permit the ALTERATION TO THE FIRST FLOOR & PARKING OF THE EXISTING BUILDING TO HOUSE THE FACILITIES FOR MT. KISCO SMOKEHOUSE. The property involved is known as 487 LEXINGTON AVENUE and described on the Village Tax Map as Section 80.64 Block 2 Lot 12 and is located on the EAST side of LEXINGTON AVENUE in a CL-1 Zoning District. Said Appeal is being made to obtain the following variances from Section(s); 110-19.1 C.(6)(b) of the Code of the Village/Town of Mount Kisco requires a l0- foot rear yard buffer. The proposed refuse encloser is situated 3.0 feet from the rear yard property line; therefore, a 7-foot rear yard buffer variance is required. 110-31 G (1) of the Code of the Village/Town of Mount Kisco states that No accessory structure, except a sign for which a permit, pursuant to Chapter 89 of this Code, has been granted and which is erected pursuant to a site plan approved by the Planning Board, shall be located or project nearer to any street line or side lot line than does the principal structure on the lot. The principal structure is 30.67 ft from the side-yard property line, and the proposed refuse enclosure is located 13.5 ft from the side-yard property line; therefore, a 17.17 ft side-yard variance is required.
