NIAGARA WHEATFIELD CENTRAL SCHOOL DISTRICT RESOLUTION FOR ANNUAL DISTRICT MEETING AND SCHOOL BOARD ELECTION WHEREAS, pursuant to Section 1716 of the Education Law, it is necessary to set the date of the District's budget hearing; and WHEREAS, pursuant to Sections 1716 and 2002 of the Education Law, it is necessary to provide for publication of the notice of the annual meeting and school board election of the District; NOW, THEREFORE, BE IT RESOLVED, by the Board of Education of the Niagara Wheatfield Central School District: 1.That the provisions of this resolution shall be effective regardless of anything to the contrary in the Board Policy Manual, or the previous minutes of this Board, or otherwise. 2.That it is hereby determined, pursuant to Section 1716 of the Education Law, that the budget hearing of the District for the presentation of the proposed 2026-2027 school district budget shall be conducted on Wednesday, May 6, 2026 at 7:00 p.m. in the Adult Learning Center, Niagara Wheatfield High School, 2292 Saunders Settlement Rd., Sanborn, Town of Lewiston, New York. 3.That pursuant to Section 2003 of the Education Law, the annual meeting and election of the District shall be held on Tuesday, May 19, 2026 from 8:00 a.m. until 9:00 p.m. at the Adult Learning Center, Niagara Wheatfield Senior High School, 2292 Saunders Settlement Rd., Town of Lewiston, New York, for the purpose of voting on: 1) the approval of the annual school district budget for the fiscal year commencing July 1, 2026 and ending June 30, 2027; 2) the purchase of buses and facilities transportation vehicles from the 2021 Capital Transportation Reserve Fund; 3) the acquisition of technology equipment from the 2021 Capital Technology Reserve Fund; and 4) the election of three (3) members of the Board of Education. The persons with the three highest vote totals will commence his/her three-year term beginning on July 1, 2026 and ending on June 30, 2029. 4.That pursuant to Section 2035 of the Education Law, the Districts' Rules for the use of Voting Machines and the Submission of Questions or Propositions to be placed thereon be conformed to those stated in the Public Notice thereof which accompanies this resolution, copies of which the District Clerk is hereby directed to make available to the public, upon request. 5.That the District is hereby directed to publish a copy of the following notice in both the Niagara Gazette and Buffalo Business First, four times in each within the seven weeks next preceding such District meeting, the first publication in each newspaper to be a least 45 days before said annual meeting and election: LEGAL NOTICE NOTICE OF ANNUAL SCHOOL DISTRICT MEETING AND SCHOOL BOARD ELECTION NIAGARA WHEATFIELD CENTRAL SCHOOL DISTRICT NOTICE IS HEREBY GIVEN that the budget hearing of the District, for presentation of the proposed 2026-2027 school district budget shall be conducted on Wednesday, May 6, 2026 at 7:00 p.m. in the Adult Learning Center, Niagara Wheatfield High School, 2292 Saunders Settlement Rd., Sanborn, Town of Lewiston, New York; TAKE FURTHER NOTICE that the Annual Meeting and School Board Election of the Niagara Wheatfield Central School District, Niagara County, New York, will be held on Tuesday, May 19, 2026 from 8:00 a.m. to 9:00 p.m. in the Adult Learning Center, Niagara Wheatfield Senior High School, 2292 Saunders Settlement Rd., Sanborn, Town of Lewiston, New York, for the purpose of voting on: 1) the approval of the annual district budget for the fiscal year commencing July 1, 2026 and ending June 30, 2027; 2) the purchase of buses and facilities transportation vehicles from the 2021 Capital Technology Reserve Fund; 3) authorization to expend from a Capital Transportation Reserve; and 4) the election of three (3) members of the Board of Education. Each petition must be filed in the Office of the Clerk of the District, 5700 West Street, Sanborn, NY 14132 between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, except holidays. Each petition must be filed in the Office of the Clerk of the District by no later than 5:00 p.m. on Monday, April 20, 2026. TAKE FURTHER NOTICE that the voting on the budget and other propositions will consist of voting on the following propositions, as well as other such matters as may be lawfully presented at the meeting; PROPOSITION NO. 1 - ADOPTION OF BUDGET Shall the following resolution be adopted, to wit: RESOLVED, that the budget for the Niagara Wheatfield Central School District, Niagara County, New York, for the fiscal year commencing July 1, 2026 and ending June 30, 2027 as presented by the Board of Education, is hereby approved and adopted and the required funds therefor are hereby appropriated and the necessary real property taxes required shall be raised by a tax on taxable property in said District to be levied and collected as required by law. The aforesaid proposition shall appear on the ballots for the voting machines used in this election in the following abbreviated form. PROPOSITION NO. 1 - ADOPTION OF BUDGET Shall the 2026-2027 school district budget be approved and adopted, the required funds thereafter appropriated and necessary property taxes levied and collected? PROPOSITION NO. 2 - AUTHORIZATION TO EXPEND FROM A CAPITAL TRANSPORTATION RESERVE Shall the Board of Education be authorized to expend from the 2021 Capital Transportation Reserve Fund an amount of up to $944,000 for the purchase of buses and facilities transportation vehicles? PROPOSITION NO. 3 - AUTHORIZATION TO EXPEND FROM A CAPITAL TECHNOLOGY RESERVE Shall the Board of Education be authorized to expend from the 2021 Capital Technology Reserve Fund an amount of up to $200,000 for the acquisition of installation of technology equipment for the District? AND FURTHER NOTICE IS HEREBY GIVEN, that absentee ballots will be obtainable during school business hours from the District Clerk, 5700 West Street, Sanborn, New York beginning April 24, 2026 between 8:00 a.m. and 4:00 p.m. Completed applications must be received by the District Clerk or designee at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the Annual Meeting and School Board Election, if the ballot is to be personally delivered to the voter. Absentee ballots must be received in the office of the District Clerk no later than 5:00 p.m., on May 19, 2026. TAKE FURTHER NOTICE that a list of persons to whom absentee ballots are issued will be available for inspection by any qualified voter of the District between the hours of 8 a.m. and 4 p.m. in the office of the District Clerk on each of the five days prior to the day of the election, and such list will be available at the polling place during the annual meeting and election. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefor known to the Inspector of Election before the close of the polls. AND FURTHER NOTICE IS GIVEN, that military voters who are qualified voters of the District may request an application for a military ballot by emailing a request to the District Clerk at rtorcasio@nwcsd.org In order to receive a military ballot, the military ballot application must be received no later than 5:00 pm on April 24, 2026. In the request for an application for a military ballot, the military voter is permitted to designate his/her preference for receiving the application for a military ballot, and the military ballot, by mail, facsimile transmission or electronic mail. All qualified military voters' ballot application and military ballot must be returned by mail or in person. Ballots for military voters shall be distributed to qualified military voters no later than April 24, 2026. Military ballots must be received (1) by the District Clerk not later than 5:00 p.m. on Tuesday, May 19, 2026, and must show a cancellation mark of the United States postal service or a foreign country's postal service, or must show a dated endorsement of receipt by another agency of the United States Government; or (2) not later than 5:00 pm on Tuesday, May 19, 2026, and be signed and dated by the military voter and one witness, with a date ascertained to be not later than the day before the election.
