ORLEANS COUNTY NOTICE OF HEARING ON PROPOSED LOCAL LAW Notice of Public Hearing NOTICE IS HEREBY GIVEN that a Public Hearing will be held on March 10th at 6:15PM at the village office at 1 Wright Street, Holley, NY 14470 to consider changes to the village law as follows: Village of Holley A Local Law 2-2026 Establishing Appointment Terms for the Clerk, Treasurer or if joined Clerk-Treasurer, and Deputy Clerk-Treasurer Section 1. Title. This local law shall be known as the “Local Law Establishing Appointment Terms for Clerk, Treasurer, and Deputy Clerk-Treasurer.” Section 2. Legislative Intent. The purpose of this local law is to establish defined appointment terms for the offices of Clerk, Treasurer, and Deputy Clerk-Treasurer of the Village of Holley in order to promote administrative continuity, accountability, and effective governance. This local law clarifies appointment durations while preserving the Mayor’s appointing authority and the Board of Trustees’ approval role. Section 3. Authority. This local law is enacted pursuant to the authority granted to villages by the New York State Constitution and the Municipal Home Rule Law, as well as applicable provisions of the New York State Village Law. Section 4. Appointment Terms. 1. The offices of Clerk, Treasurer, and Deputy Clerk-Treasurer of the Village of Holley shall each be appointed by the Mayor with the approval of the Board of Trustees, in accordance with the provisions of Village Law. 2. The Clerk and Treasurer shall each be appointed for a term of two (2) years, and each shall be eligible for reappointment upon the expiration of their respective terms. 3. The Deputy Clerk-Treasurer shall be appointed for a term of one (1) year, and shall be eligible for annual reappointment. 4. Nothing herein shall be construed to limit the authority of the Mayor and Board of Trustees to fill vacancies or make appointments as otherwise permitted by law. Section 5. Supersession. This local law supersedes any prior inconsistent local law, resolution, or regulation of the Village of Holley relating to the terms of appointment for the Clerk, Treasurer, and Deputy Clerk-Treasurer. Section 6. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this local law shall be adjudged by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part thereof directly involved. Section 7. Effective Date. This local law shall take effect immediately upon filing with the Secretary of State as provided by law.
