NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Planning Board of the Town of Orchard Park, Erie County, New York at the Community Activity Center, 4520 California Road, Orchard Park, New York on the 12th day of March 2026 at 7:00 P.M. in the matter of the application of William Mutka requesting Preliminary Plat Plan Approval of “V/L 7894 Milestrip Road,” a Single-Family 4-Lot Subdivision, 4.94 +/-Acres Vacant Land, in an R-2 Residential Zoning District, located on the north side of Milestrip Road, west of Transit Road, pursuant to Article 16, Section 276 of the Town Law. (SBL #154.17-1-9.11). This proposed project is bounded and described as follows: ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Orchard Park, County of Erie and State of New York, being part of Lot No. 2, Township 10, Range 7 of the Buffalo Creek Reservation as described in a Deed recorded in the Erie County Clerk's Office in Liber 1336 of Deeds at page 66, less a certain Deed and Easement to the United States of America as described in Lis Pendens recorded in the Erie County Clerk's Office in Liber 248 of Lis Pendens at page 289 and less a certain Deed and Easement to the Town of Orchard Park and the Orchard Park Water District No. 15 as described in Deed recorded in the Erie County Clerk's Office in Liber 7339 of Deeds at page 107, described as follows: COMMENCING at a point in the south line of Lot No. 2, as described in a Deed recorded in the Erie County Clerk's Office in Liber 7269 of Deeds at page 441, which is also the center line of Milestrip Road, distant 96.94 feet easterly from the southwest corner of said Lot No. 2; thence easterly along the center line of Milestrip Road, 678.56 feet to the southwest corner of lands conveyed to Clarence E. Oldenburg and wife by Deed recorded in the Erie County Clerk's Office in Liber 2741 of Deeds at page 189; thence northerly parallel with the east line of Lot No. 2 and along the west line of aforesaid Oldenburg lands, 399.04 feet to the southeast corner of lands conveyed to the Town of Orchard Park and the Orchard Park Water District No. 15 by Deed recorded in the Erie County Clerk's Office in Liber 7339 of Deeds at page 107; thence westerly and at right angles to the east line of Lot No. 2 and the west line of the aforesaid Oldenburg lands, a distance of 100 feet; thence northerly along the west line of the aforesaid lands of the Town of Orchard Park and the Orchard Park Water District No. 15 and at right angles to previously described south line of the lands of the Town of Orchard Park and the Orchard Park Water District No. 15; a distance of 65.89 feet to the southeast line of lands of the United States of America as described in Lis Pendens recorded in the Erie County Clerk's Office in Liber 248 of Lis Pendens at page 289; thence southwesterly along the southeasterly line of said lands of the United States of America, 36.22 feet; thence northwesterly along the southwesterly line of said lands of the United States of America, 245 feet thence westerly parallel with the center line of Milestrip Road, 456.73 feet to a point in a line drawn parallel with and distant 96.94 feet easterly from the west line of said Lot No. 2; thence southerly along said parallel line, 674.04 feet to the point or place of beginning. EXCEPTING THEREFROM premises conveyed by Deed recorded in Liber 10902 of Deeds at page 564. FURTHER EXCEPTING the following described premises: ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Orchard Park, County of Erie and State of New York, being part of Lot No. 2, Township 10, Range 7 of the Buffalo Creek Reservation, further bounded and described as follows: BEGINNING at a point in the center line of Milestrip Road, being (66' wide), said center line being the southerly line of said Lot No. 2, distant 96.94 feet easterly from the westerly line of said Lot No. 2; thence northerly at an exterior angle of 90°, 46' 28" and parallel with the westerly line of said Lot No. 2, a distance of 674.04 feet to a point; thence easterly and parallel with the center line of Milestrip Road and said southerly line of Lot No. 2 a distance of 200.00 feet to a point; thence southerly and parallel with the westerly line of said Lot No. 2, a distance of 674.04 feet to a point in the center line of Milestrip Road and said southerly line of Lot No. 2; thence westerly along the center line of Milestrip Road and said southerly line of Lot No. 2, a distance of 200.00 feet to the point or place of beginning. Together with all right, title and interest of, in and to any streets and roads abutting the above described premises.
