LEGAL NOTICE OF ANNUAL MEETING, BUDGET VOTE AND BOARD ELECTION HAMBURG CENTRAL SCHOOL DISTRICT ERIE COUNTY, NEW YORK NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the Hamburg Central School District of the Town of Hamburg, Erie County, New York (the “District”) will be held at Armor Elementary School located at 5301 Abbott Road, Hamburg, New York on Tuesday, May 12, 2026, at 6:00 PM for the presentation of the budget for the 2026-2027 fiscal year of the District. NOTICE IS HEREBY FURTHER GIVEN, that the annual meeting, vote and election of the qualified voters of the District will be held in the gymnasium of the Hamburg High School, located at 4111 Legion Drive, Hamburg, New York on Tuesday, May 19, 2026, at which time and place such vote and election will be held between the hours of 7:00 AM and 9:00 PM. NOTICE IS HEREBY FURTHER GIVEN, that the vote upon the appropriation of the necessary funds to meet the District’s estimated expenditures for the 2026-2027 fiscal year and to authorize the requisite portion thereof to be raised by a tax on the taxable property of the District to be levied and collected as required by law will be presented as PROPOSITION NO. 1 . NOTICE IS HEREBY FURTHER GIVEN, that the vote upon the establishment of a capital reserve fund will be presented as PROPOSITION NO. 2 , and shall read substantially as follows: PROPOSITION NO. 2 ESTABLISHMENT OF A CAPITAL RESERVE FUND Shall the following resolution be adopted? RESOLVED, that the Board of Education (the “Board”) of the Hamburg Central School District, Erie County, New York (the “District”) is hereby authorized to establish a capital improvements reserve fund pursuant to Section 3651 of the Education Law of the State of New York (the “Fund”); that the Fund shall be known as the “Capital Improvements Reserve Fund– 2026” of the District; that the Fund shall be established for the purpose of financing, in whole or in part, the acquisition, construction, reconstruction, expansion, renovation, alteration and improvement of buildings, facilities, sites and real property by the District, or the District’s share of the cost of any capital improvements project undertaken by a Board of Cooperative Educational Services (“BOCES”), of which the District is or may be a component district, including, in all cases, the acquisition of necessary furnishings, equipment, machinery and apparatus; that the ultimate amount of such Fund shall be not greater than $10,000,000 (plus interest earned thereon); that the probable term of such Fund shall be not longer than ten (10) years; and that the permissible sources from which the Board is authorized to appropriate monies to such Fund from time to time shall be (a) unappropriated fund balance of the District, (b) State aid received as reimbursement for expenditures by the District in connection with District capital improvements (whether or not such improvements were financed in whole or in part from the Fund), (c) the proceeds from the sale of unneeded District real or personal property and (d) such other sources as the Board or the voters of the District may direct from time to time. NOTICE IS HEREBY FURTHER GIVEN, that there shall be voting to elect two (2) members of the Board of Education of the District for three-year terms commencing July 1, 2026, and expiring on June 30, 2029, and one (1) member of the Board of Education of the District for a two-year term commencing immediately after the election (upon filling the oath of office), and expiring on June 30, 2028. NOTICE IS HEREBY FURTHER GIVEN, that a copy of the statement of the amount of money whi ch will be required to fund the District’s budget for 2026-2027, exclusive of public monies, may be obtained by any resident of the District during business hours Monday through Friday 9:00 AM – 4:00 PM (excluding holidays) at each school building in the District beginning Tuesday, May 5, 2026, up through and including Tuesday, May 19, 2026, the date set for the budget vote. NOTICE IS HEREBY FURTHER GIVEN, that all candidates for the office of member of the Board of Education shall be nominated by petition. Petitions nominating candidates for the office of member of the Board of Education shall be filed with the District Office in the Hamburg Administration Building, between 9:00 AM and 4:00 PM, and no later than 5:00 PM on Monday, April 20, 2026. Each petition shall be directed to the District Clerk and shall be signed by at least 31 voters of the District, stating their name and residence, and must state the name and residence of the candidate. NOTICE IS HEREBY FURTHER GIVEN, that applications for absentee ballots and early mail ballots are obtainable between the hours of 8:00 AM and 4:00 PM Monday through Friday, except holidays, from the District Office. Completed applications must be received by the District Office at least seven (7) days before the election (May 12, 2026) if the ballot is to be mailed to the voter, or by 4:00 PM on the day before the election (May 18, 2026) if the ballot is to be delivered personally to the voter. Completed absentee ballots and early mail ballots must be received no later than 5:00 PM on Tuesday, May 19, 2026. NOTICE IS HEREBY FURTHER GIVEN that military voters who are qualified voters of the school district may apply for a military ballot. Applications for military ballots may be obtained from the District Clerk’s Office and the military voter may designate a preference to receive the application and/or the military ballot by mail, fax or email. Completed applications for military ballots must be received by the District Clerk or her designee by no later than 5:00 p.m. on April 23, 2026. NOTICE IS HEREBY FURTHER GIVEN, that a list of persons to whom absentee ballots and early voting are issued will be available for inspection to qualified voters of the District in the District Office during regular business hours beginning five days prior to the day of the election and such list will be available at the polling place on May 19, 2026, the day set for the election. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reasons for such challenge. Such written challenge shall be transmitted by the clerk to the Chief Election Inspector before the close of the polls.
