TOWN OF NEW WINDSOR PUBLIC NOTICE TOWN BOARD OF THE TOWN OF NEW WINDSOR COUNTY OF ORANGE : STATE OF NEW YORK ---------------------------------------------------------------------x NOTICE AND ORDER In the Matter of an Unsafe or Collapsed Structure PURSUANT TO CHAPTER Owned by 113 OF THE TOWN CODE OF THE TOWN DNM BUILDERS, LLC OF NEW WINDSOR ENTITLED: “UNSAFE BUILDINGS” REQUIRING STRUCTURE TO BE MADE PREMISES: 136 JOHN STREET, NEW WINDSOR, SAFE AND SECURE ORANGE COUNTY, NY SECTION 13 - BLOCK 4 - LOT 3 --------------------------------------------------------------------x SIRS: 1. THE TOWN BOARD OF THE TOWN OF NEW WINDSOR, pursuant to a Town Board Resolution dated March 4, 2026, has caused an inspection and report to be completed on premises identified as 136 JOHN STREET, NEW WINDSOR, ORANGE COUNTY, NEW YORK, further identified on the Town of New Windsor tax maps as Section 13, Block 4, Lot 3. Said inspection was performed by the Engineer for the Town Jamison Zajac, P. E., and Francis Bedetti, III, Assistant Fire Inspector, and a report regarding same dated 12 February 2026 was prepared and provided to this Board. . 2. The aforementioned report notes that the dwelling has sustained major damage resulting from a fire and that subsequent damage to the residence’s interior also appears to have occurred in the years the residence has remained vacant due to exposure to weather events via the openings in the building envelope. The residence is not in an occupiable condition. Damage from fire and water has compromised the structure’s integrity and the engineer opines that the residence is unsafe to the public. A copy of the aforementioned report is attached as Exhibit A and incorporated into this Notice and Order. 3. YOU ARE HEREBY NOTIFIED that you are directed to engaged the services of a Licensed Design Professional to issue a report, within fourteen (14) days of service of this Notice, to the Town of New Windsor Building Department and the Town of New Windsor Town Attorney’s Office, both located at 555 Union Avenue, New Windsor, NY, and thereafter immediately proceed to make the structure at 136 John Street, New Windsor, New York, safe and secure or demolish the structure. Said action to make safe and secure or demolish the structure, must be completed within thirty (30) days after the date of service of this Notice. 4. YOU ARE ALSO NOTIFIED that a hearing shall take place before the Town Board of the Town of New Windsor on April 1, 2019 at 7:00 p.m. in Town of New Windsor Town Hall, 555 Union Avenue, New Windsor, New York 12553, at which time the Town Board of the Town of New Windsor will consider the action which you are directed to have taken by that date, and to consider any further action which the Town shall undertake for securing, repair or removal of the building by Town forces or contract. 5. All costs and expenses incurred by the Town of New Windsor in connection with the proceedings to remove or secure the building shall be assessed against the land on which the building is located, specifically Section 13, Block 4, Lot 3. 6. The Town Attorney is directed to serve notice of this action in accordance with Section 113-3 of the Town Code of the Town of New Windsor, including the recording of a Notice of Pendency in the Office of the Clerk of the County of Orange. 7.
