NOTICE OF PUBLIC HEARING, BUDGET VOTE AND ELECTION NORTH TONAWANDA CITY SCHOOL DISTRICT NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the North Tonawanda City School District, Niagara County, New York, will be held at the North Tonawanda Fine Arts Center, 405-455 Meadow Drive, North Tonawanda, New York, in said District on the 12th of May 2026, at 7:00 p.m., prevailing time, for the transaction of business as authorized by the Education Law, including the following items: 1. To receive such reports of the School District as shall be submitted. 2. To discuss all the items hereinafter set forth to be voted upon by voting machines at the vote and election to be held on May 19, 2026. 3. To transact such other business as may properly come before the meeting pursuant to Education Law of the State of New York and acts amendatory thereto. 4. For the presentation of the Budget. PROPOSITION NO. 1 2026-2027 Budget RESOLVED, that the budget for the City School District of the City of North Tonawanda, Niagara County, New York (the “District”) for the fiscal year commencing July 1, 2026 and ending June 30, 2027, as presented by the Board of Education of the District, is hereby approved and adopted and the required funds therefor are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District, to be levied and collected as required by law. PROPOSITION NO. 2 CAPITAL IMPROVEMENTS PROJECT, 2026 YesNo Shall the following bond resolution of the Board of Education of the City School District of the City of North Tonawanda, Niagara County, New York (the “District”) be approved? A BOND RESOLUTION, DATED APRIL 21, 2026, CLARIFYING AND CONFIRMING ACTION ON MARCH 25, 2026 TAKEN BY THE BOARD OF EDUCATION OF THE CITY SCHOOL DISTRICT OF THE CITY OF NORTH TONAWANDA, NIAGARA COUNTY, NEW YORK (THE “DISTRICT”), AUTHORIZING THE DISTRICT (1) TO UNDERTAKE (SUBJECT TO THE APPROVAL OF THE VOTERS OF THE DISTRICT) A CAPITAL IMPROVEMENTS PROJECT CONSISTING OF THE RECONSTRUCTION AND RENOVATION, IN PART, AND THE CONSTRUCTION OF IMPROVEMENTS AND UPGRADES TO VARIOUS DISTRICT BUILDINGS AND FACILITIES AND THE SITES THEREOF (COLLECTIVELY, THE “PROJECT”), AT AN ESTIMATED MAXIMUM COST OF $59,900,000; (2) TO EXPEND OR APPLY TOWARD THE PROJECT DURING THE CURRENT FISCAL YEAR OF THE DISTRICT (A) THE ENTIRE BALANCE (WHICH STOOD AT APPROXIMATELY $10,406,015 AS OF JUNE 30, 2025), PLUS ANY ADDITIONAL INTEREST EARNED, FROM THE DISTRICT'S 2021 CAPITAL IMPROVEMENTS AND TRANSPORTATION RESERVE FUND, AND THEN TO TERMINATE SUCH FUND AND (B) $1,593,985 FROM THE DISTRICT?S 2025 CAPITAL IMPROVEMENTS AND TRANSPORTATION RESERVE FUND; AND (3) TO ISSUE SERIAL BONDS OF THE DISTRICT IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $47,900,000 TO FINANCE THE BALANCE OF THE COST OF THE PROJECT, AND DELEGATING THE POWER TO ISSUE BOND ANTICIPATION NOTES IN ANTICIPATION OF THE SALE OF SUCH OBLIGATIONS TO THE PRESIDENT OF THE BOARD OF EDUCATION OF THE DISTRICT. PLEASE TAKE FURTHER NOTICE that an Environmental Assessment Form (along with a clarifying resolution and certain supporting documents) has been completed for all of the anticipated work involved in the Project, which constitutes a Type I action under the State Environmental Quality Review Act (“SEQRA”), a thorough review of the Project's potential environmental impacts has been undertaken, it has been found that the Project will not result in a significant adverse impact on the environment, and a reasoned elaboration of the SEQRA review and findings has been provided in a Negative Declaration. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to § 1716 of the Education Law, the Board of Education of said District will have prepared and completed a detailed statement in writing of the amount of money which will be required for the ensuing fiscal year 2026-2027, for school purposes, exclusive of public monies, specifying the several purposes and the amount of each, and copies of such statement will be available upon request, to residents within the said school district, during business hours beginning May 5, 2026, except Saturday, Sunday or holidays, at the Administration Office, 176 Walck Road, North Tonawanda and at any school building of the District. AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee ballots will be obtainable during school business hours from the District Clerk beginning May 5, 2026; completed applications must be received by the District Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election if the ballot is to be delivered personally to the voter. No absentee ballot shall be canvassed unless it shall have been received by the District Clerk not later than 5:00 p.m., prevailing time, on May 19, 2026. A list of persons to whom absentee ballots are issued will be available for inspection to qualified voters of the District in the Office of the District Clerk on and after May 19, 2026, between the hours of 8:00 a.m. and 4:00 p.m., prevailing time, on weekdays prior to the day set for the annual election and on May 19, 2026, the day set for the election. Any qualified voter then present in the polling place may object to the voting of the ballot upon appropriate grounds by making his/her challenge and the reasons therefore known to the Inspector of Election before the close of the polls. AND FURTHER NOTICE IS HEREBY GIVEN, that the qualified voters of the School District shall be entitled to vote at said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older, and (3) a resident within the School District for a period of thirty (30) days preceding the annual vote and election. The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law § 2018-c. Such form may include a driver's license, non-driver identification card, a utility bill or a voter registration card. Upon offer of proof of residency, the School District may also require all persons offering to vote to provide their signature, printed name and address. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to §2608 of the Education Law, petitions nominating candidates for the office of member of the Board of Education shall be filed with the Clerk of said School District between 9:00 a.m. and 4:00 p.m., prevailing time, during any business day, but not later than April 29, 2026, the twentieth (20th) day preceding the annual school district election, at which the candidates so nominated are to be elected. The petition(s) nominating a candidate(s) must be signed by at least one hundred (100) persons qualified to vote in school elections of the District. Nominating petitions must state the name and residence of each signer and must state the name and residence of the candidate. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to a rule adopted by the Board of Education in accordance with §2601-A, §2008 and §2035 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at said election, must be filed with the Board of Education at the Administration Building, 176 Walck Road, North Tonawanda, New York, on or before April 21, 2026, at 4:00 p.m., prevailing time; must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least 100 qualified voters of the District; and must state the name and residence of each signer.
