LEGAL NOTICE
LEGAL NOTICE FOR PUBLIC HEARING TO RECEIVE COMMENT ON THE TOWNOF SPRINGWATER SANITARY SEWER DISTRICT IMPROVEMENTS
WHEREAS, the Town Board of the Town of Springwater has determined that it is necessary to make significant improvements to the waste water treatment facilities within the Town of Springwater Sanitary Sewer District (the “District”), since such facilities do not function properly and repeatedly fail to meet effluent limits set forth in a State Pollutant Discharge Elimination Permit (the “SPDES”) permit issued by the New York State Department of Environmental Conservation (the “DEC”); and
WHEREAS, the Town Board of the Town of Springwater recognizes there is a need to provide safe and effective treatment of sanitary wastewater and that appropriate improvements to the existing collection and treatment facilities will eliminate the public health risks associated with insufficient treatment of sanitary waste within said District; and
WHEREAS, in order to accomplish such need, the Town Board of the Town of Springwater is proposing to make additional improvements to the waste water treatment plant including: replacement of the existing recirculating media filter facility with a new sequencing batch reactor (the “SBR”) treatment package plant, two sequencing batch reactor tanks and an aerated sludge holding tank all constructed as a rectangular structure with poured-in-place reinforced concrete, a waste sludge holding tank, reuse of the existing UV disinfection facility located within the existing operations building, two parallel UV units with a capacity of 75 gallons per minute and new sludge drying beds constructed in a portion of the existing vegetated submerged bed constructed wetland system; and
WHEREAS, the Town Board is empowered to authorized such improvements subject to the provisions of New York State Town Law §202-b; and
WHEREAS, this Public Hearing Notice is made pursuant to and in compliance with Town Law§ 193; and
NOW THEREFORE BE IT RESOLVED, that pursuant to New York State Town Law, a public hearing be held on the 11 th day of May, 2026 at 6:30 p.m. at the Town Hall located at 8022 South Main Street, Springwater, New York, with respect to the proposed improvements: replacement of the existing recirculating media filter facility with a new sequencing batch reactor (the “SBR”) treatment package plant, two sequencing batch reactor tanks and an aerated sludge holding tank all constructed as a rectangular structure with poured-in-place reinforced concrete, a waste sludge holding tank, reuse of the existing UV disinfection facility located within the existing operations building, two parallel UV units with a capacity of 75 gpm and new sludge drying beds constructed in a portion of the existing vegetated submerged bed constructed wetland system, all of which are set-forth in the Engineering Report ("Engineering Report") dated July 2025, prepared by CHA Consulting, Inc., which said report is on file in the Springwater Town Clerk's office; and be it further
RESOLVED, that the maximum amount proposed to be expended for the improvements is $6,000,000.00; and be it further
RESOLVED, that the anticipated cost for such improvements shall be borne by the Town of Springwater Sanitary Sewer District; and be it further
RESOLVED, that a copy of the Engineering Report dated July 2025 and revised, prepared by CHA Consulting, Inc., describing the proposed improvements to be constructed shall be available for public inspection at the Springwater Town Clerk's Office; and be it further
RESOLVED, that at the time and date aforementioned, all interested parties may be heard concerning the proposed improvements to the Town of Springwater Sanitary Sewer District as noted above and described in more detail in the Engineering Report.
