THIS IS NOT A PERMIT New York State Department of Environmental Conservation Notice of Complete Application Date: 04/10/2026 Applicant: ONEIDA COUNTY 800 PARK AVE UTICA, NY 13501-2939 Facility: Griffiss International Airport Triangle Development 150 Perimeter Road Rome, NY 13441 Application ID: 6-3013-00361/00001 Permits(s) Applied for: 1 - Article 11 Endangered/Threatened Species (Incidental Take) Project is located: in ROME in ONEIDA COUNTY Project Description : The applicant proposes 256 total acres of disturbance associated with the Griffiss International Airport Triangle Development located at 150 Perimeter Road in the City of Rome, Oneida County. Development is associated with a new Chobani dairy processing plant and includes a dairy processing plant building, gateway building, dairy receiving building, utility building, driver facility, and on-site wastewater treatment plant. A portion of the project area is known to be occupied by Upland Sandpipers (Bartramia longicauda), state listed threatened species. An Incidental Take Permit is required because the Department has determined the project will result in a “take” of the species pursuant to Environmental Conservation Law Section 11-0535 and 6 NYCRR Part 182 through the adverse modification of 81.18 acres of occupied habitat. The applicant has developed a Net Conservation Benefit Plan (NCBP) that will be implemented to provide a net conservation benefit for the species concerned. The NCBP involves the protection and management of 155.48 acres of suitable off-site grassland bird habitat for 45 years. Deliverables of the NCBP include initial vegetation management to enhance suitable habitat, vegetation monitoring, annual breeding grassland bird surveys, prohibition of disturbances during the nesting season, and ongoing habitat management. Availability of Application Documents : Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other involved agencies was performed and a Negative Declaration is on file. SEQR Lead Agency Oneida County State Historic Preservation Act (SHPA) Determination A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required. DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29) The proposed action is subject to CP-29.
