BENDER LEGAL NOTICE FOR PUBLICATION The Court finds that the service of summons cannot be made other than by publication on Defendants The Unknown Heirs, Devisees, Legatees, Administrators, Executors, Spouses and Assigns, and the Unknown Guardians of Minor And/Or Incompetent Heirs, if any, of Roger W. Kimmey, Harry Kimmey, Carol Kimmey, whose last known place of residence is unknown. Each Defendant will take notice that on November 11, 2025, Plaintiff filed a Complaint for Foreclosure in the Fayette County Court of Common Pleas, being CVE20250430 alleging that Plaintiff is the holder of certain Tax Certificates: 2023-N-FA-132 in the amount of $1,606.93 2024-S-FA-031 in the amount of $809.54 2025-FA-044 in the amount of $1,570.34 purchased from the Fayette County Treasurer in conformity with statutory authority. Plaintiff is vested with the first lien previously held by the State of Ohio and its taxing districts for the amount of taxes, assessments, penalties, charges and interest charged against the subject parcel, which has an address of: 4903 US Highway 62 Lot 4, Washington Court House, OH 43160 PPN: 010-021-0-03-052-00, A copy of the full legal description can be found in the Fayette County Recorders Office. Plaintiff further alleges that the certificate redemption price of each certificate is due and unpaid, and that it has filed a Notice of Intent to Foreclose with the Fayette County Treasurer, which the Treasurer has certified indicating the Certificate has not been redeemed. Plaintiff further alleges that there are also due and payable taxes, assessments, penalties and charges on the subject parcel that are not covered by the Certificate, including all costs related directly or indirectly to the Tax Certificate (including attorneys fees of the holders attorney and fees and costs of the proceedings). Plaintiff further alleges that it is owed the sums shown before on each Tax Certificate, plus interest at a rate contractually agreed to between NAR OHIO, LLC and the Fayette County Treasurer, to the date of the Notice of Intent to Foreclose, and then at the rate of 18% per annum thereafter and on any other subsequently purchased Tax Certificate which are a first and prior lien against the real property described below, superior to all other liens and encumbrances upon the subject Parcel. Plaintiff prays that the Defendants named in this Notice are required to answer and assert their interest in said premises within 28 days after that last date of publication or be forever barred from asserting the same. Plaintiff further prays that all taxes, assessments, penalties and interest due and unpaid, together with the costs of the action, including reasonable attorney fees, on the Tax Certificates be found to be good and valid first lien on said premises; that the equity of redemption of said premises be foreclosed, said premises sold as provided by law, and for such other relief as may be just and equitable.
