Plaintiff brings this civil action arising out of Defendants conduct giving rise to damages and related claims asserted in the live pleadings on file with the Court. Defendant Franklin Pupo Fernandez is a named Defendant in this matter. Plaintiff has made multiple diligent attempts to locate and personally serve Defendant Franklin Pupo Fernandez at all known addresses reasonably associated with Defendant, including addresses identified through investigation, public records, and prior residence and property information. Despite these efforts, service of process has been unsuccessful and Defendants current whereabouts remain unknown. Plaintiff has exercised due diligence in attempting to obtain personal service on Defendant Franklin Pupo Fernandez but has been unable to locate Defendant for service. Accordingly, Plaintiff seeks citation by publication pursuant to Rules 109 and 114 of the Texas Rules of Civil Procedure. Plaintiff seeks recovery of damages as pled in Plaintiffs live petition, together with all costs of court, attorneys fees where applicable, and such other and further relief, at law or in equity, to which Plaintiff may be justly entitled. This citation shall be served by the sheriff or any constable of any county of the State of Texas or by the clerk of the court in which the case is pending, by having the same published ONCE each week for FOUR (4) CONSECUTIVE WEEKS, the first publication to be at least 28 days before the return of the citation.
