TO: Unknown Heirs at Law of Dolly Oppenheimer and Unknown Heirs at Law of Joyce Sherwood, and to all who it may concern.
Notice to Defendant: You have been sued. You may employ an attorney. You (and each of you) are hereby commanded to appear before the 477th Judicial District Court at the Courts Building thereof, located at 1450 E. McKinney,2nd floor, Denton, Denton County, Texas 76209 by filing a written answer at or before 10:00 o’clock a.m. on the first Monday following the expiration of forty-two (42) days from the date of the issuance of this citation, same being May 04, 2026. If you do not file an answer by May 04, 2026 a default judgment may be taken against you. In addition to filing a written answer with the clerk, you may also be required to make initial disclosures to the other parties of this suit. Plaintiff’s Petition was filed in said Court on 02/17/2026 in Cause No.26-1525-477 on the docket of said Court styled: “US Bank Trust National Association, Not in its Individual Capacity but Solely as Owner Trustee for VRMTG Asset Trust v. Nash Hanks, Obie Hanks Jr., Will Oppenheimer, III, the Unknown Heirs at Law of Dolly Oppenheimer, deceased, and the Unknown Heirs at Law of Joyce Sherwood, deceased” and the parties involved in this suit are: US Bank Trust National Association; Nash Hanks; Joyce Sherwood; Obie Hanks, Jr.; Will Oppenheimer, III; Unknown Heirs at Law of Dolly Oppenheimer; Unknown Heirs at Law of Joyce Sherwood.
A brief statement of the nature of this suit is as follows, declaring that all of Decedent’s heirs at law have been made. Declaring that Plaintiff’s has a statutory probate lien interest in the Property; Declaring that Plaintiff’s lien interest in the Property through the Deed of Trust statutory probate lien shall be enforced by a non-judicial foreclosure. Ordering writ of possession issue against any occupant of the Property. Awarding attorney fees and costs of suit; Granting all other relief. Newspaper publication requires citation must be published once each week for 4 consecutive weeks, and the first publication must be at least 28 days before the return is filed.
