NOTICE OF INTENTNotice is hereby given that the Town Council of Huachuca City, Arizona will hold a public hearing to consider approval of proposed changes to the Town's Transaction Privilege Tax (TPT) Code pursuant to A.R.S. Section 42-6054. The proposed changes will increase the Town's TPT rate with the exception of the mining and the retail sales: food for home consumption tax classifications. This item will appear on the action portion of the Council agenda to allow an opportunity for public comment.The hearing will be held at 6 p.m. on May 28, 2026, at the Council chambers located at 500 N Gonzales Blvd., Huachuca City, AZ 85616. AN ORDINANCE OF THE TOWN OF HUACHUCA CITY, ARIZONA, AMENDING THE TAX CODE TO INCREASE THE TRANSACTION PRIVILEGE TAX RATE IMPOSED ON SELECTED TAX CLASSIFICATIONS BELOW; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE GRANDFATHERING OF CERTAIN TRANSACTIONS; AND DESIGNATING AN EFFECTIVE DATE OF AUGUST 1, 2026.
BE IT ORDAINED by the Mayor and Council of the Town of HUACHUCA CITY, Arizona, as follows:
Section I. Increasing Selected Transaction Privilege Tax Rates
The tax rate provided in each of the following Sections of the Town tax code is hereby increased from one and nine-tenths percent (1.9%) to two and nine-tenths percent (2.9%):

Section II. Increasing Selected Transaction Privilege Tax Rates
The tax rate provided in the following Section of the Town tax code is hereby increased from one percent (1%) to two and nine-tenths percent (2.9%):
Section 9A-445 Rental, Leasing and Licensing for Use of Real Property.
Section III. Severability
If any section, subsection, sentence, clause, phrase, or portion of this ordinance or any other amendment adopted herein by reference is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
Section IV: Effective Date
The provisions of this ordinance shall be effective on and after August 1, 2026.
Section V. Grandfathering
Notwithstanding any other provision of the Huachuca City Tax Code, the Town shall tax at a rate of one and nine-tenths percent (1.90%) all transactions creating transaction privilege or use tax liability under the Huachuca City Tax Code where the transaction is established under a written contract that was entered into and executed prior to August 1, 2026. This grandfathering of certain transactions lasts only so long as the term of the contract described above or until that contract is renegotiated between the parties, whichever occurs first.Date: May 13, 2026SVH002414
