Ordinance No. 26-999An ordinance approving the final plat of Taylor place and accepting thededication of the streets therein to the City of Clarksville, Arkansas,and for other purposesWhereas, the final plat of Taylor Place, to the City of Clarksville,Arkansas, was prepared by Allen Miller, PLS, dated the 12th day of March2026; andWhreas, the final plat was approved by the City of Clarksville PlanningCommission on the 23rd day of April 2026; andWhereas, the City Engineer has reviewed the plat and supportingdocuments; andWhereas, acceptance of the dedication of streets, rights-of-way, andeasements shown on the plat is required by Arkansas Code Annotated §14-301-102 before such dedications become effective as public streets orunder the care or control of the City Council;Now, therefore, be it ordained by the City Council of the City ofClarksville, Arkansas:Section 1: The final plat of Taylor Place, to the City of Clarksville,Arkansas, as shown by the plat made by Allen Miller, PLS, on the 12thday of March 2026, and approved by the City of Clarksville PlanningCommission on the 23rd day of April 2026 (a copy of which plat isattached hereto and incorporated herein by reference), is herebyapproved.Section 2: The streets, rights-of-way, utility and drainage easements,and all other public dedications shown on said plat are hereby acceptedand confirmed as dedicated to the public use and accepted by the City ofClarksville, Arkansas, pursuant to Arkansas Code Annotated § 14-301-102.Section 3: Approval of this plat and acceptance of the dedications andimprovements are conditional upon the submission by the developer of aperformance bond (or irrevocable letter of credit in lieu thereof) in anamount equal to the cost of constructing the remaining portion ofutilities and improvements not yet in place and approved by the CityEngineer of the City of Clarksville as of the date of this Ordinance.Said bond (or letter of credit) must be in a form and amount approved bythe City Engineer of the City of Clarksville.Section 4: After receipt of the required bond (or irrevocable letter ofcredit), the City Clerk and City Attorney of the City of Clarksville,Arkansas, are hereby directed to complete all necessary steps to fileand record said plat in the Office of the Circuit Clerk and Recorder ofJohnson County, Arkansas.Section 5: Due to the immediate need to facilitate growth anddevelopment within the city limits of the City of Clarksville, Arkansas,which will aid in the City's financial and economic stability andpromote the health, safety, and welfare of its residents, an emergencyis hereby declared, and this Ordinance shall be effective immediatelyupon its passage and approval.Adopted this 11th day of May 2026.Approved: David Rieder, MayorAttest: Lisa Venson, Clerk/Treasurer(Published in the Johnson County Graphic May 20, 2026.
