ORDINANCE NO. 899AN ORDINANCE PERMITTIN G OPERATION OFUTILITY TA SK VEHICLES ON PUBLIC STREETS ANDHIGHWAY S WITHIN THE CITY OF DEWITT , ARKANSAS, SUBJECT TO CERTAIN REQUIREMENTS,DECLARIN G AN EMERGENCY , AND FOR OTHERPURPOSESWHEREAS, pursuant to Ark. Code Ann. § 27-21-11l(a) and (b), a person may operate a utility task vehicle onpublic streets or highways when such streets or highwaysare designated by an ordinance adopted by the city as beingopen to the operation of a utility task vehicle and the utilitytask vehicle and its operator meet the requirements ofArk. Code Ann.§ 27-21-101, et seq.; andWHEREAS, pursuant to Ark. Code Ann.§ 27-21-102, autility task vehicle is defined as:(5)(A)“Utility task vehicle” means a vehicle that:(i)Is eighty inches (80”) or less in width;(ii)Travels on four (4) or more low-pressure tires;(iii)Has a steering wheel;(iv)Has non-straddle seating;(v)Has a rollover protection system;(vi)Is designed for or capable of travel over unimprovedterrain; and(B)“Utility task vehicle” does not include an all-terrainvehicle, a golf cart, a riding lawnmower, or a lawn orgarden tractor.NOW, THEREFORE, BE IT ORDAINED BY THE CITYCOUNCIL OF THE CITY OF DEWITT , ARKAN SAS,THAT :Section 1. Except as provided in Section 2 below, allpublic streets and highways within the boundaries andjurisdiction of the City of DeWitt, Arkansas, are herebydesignated as being open to the operation of a utility taskvehicle as defined under Ark. Code Ann.§ 27-21-102(5)but specifically and expressly subject to the condition thatthe utility task vehicle and the operator of the utility taskvehicle meet the requirements of Ark. Code Ann.§ 27-21-101, et seq. (Chapter 21 of Title 27 of the ArkansasCode Annotated), which also, among other matters, providesthe penalty for violation thereof.Section 2. In compliance with Ark. Code Ann.§ 27-21-11 l(d), the City of DeWitt does not designate a publicstreet or highway within the jurisdiction of the City of De-Witt, Arkansas, as being open to the operation of a utilitytask vehicle if the public street or highway:(A) Has a posted speed limit that exceeds fifty-five milesper hour (55 m.p.h.);(B) Is a divided four-lane highway; or(C) Is located in a state park.Section 3. The regulation of motor vehicle traffic in theCity of DeWitt is immediately necessary for the protectionand preservation of the health and safety of the inhabitantsof the City of DeWitt, Arkansas.
