NOTICE OF RULE MAKING
The Department of Human Services (DHS) announces for a public comment period of thirty (30) calendar days a notice of rulemaking for the following proposed rule under one or more of the following chapters, subchapters, or sections of the Arkansas Code: §§20-76-201, 20-77-107, and 25-10-129. The projected effective date of the rule is August 1, 2026, if approved. There is no fiscal impact. 
The Division of Medical Services (DMS) implements Act 482 of 2025 and provisions of Acts 303 and 872 of 2023 and completes the necessary state plan revisions to align reimbursement rules with current practice authority for physician assistants and clinical nurse specialists. Physician assistants and clinical nurse specialists will be able to bill independently for services rendered to Medicaid beneficiaries and serve as primary care providers in the Medicaid Primary Care Case Management program.
