BID ADVERTISEMENT NOTICE IS HEREBY GIVEN that the City of Modesto, in the County of Stanislaus, State of California, will receive Statements of Qualifications (SOQ) for the following work: UPGRADE TRAFFIC OPERATIONS CONTROL ROOM This project is listed on the OpenGov Procurement Portal under "Bid Opportunities" on the City's website, http://www.modestogov.com/257/Contracting-Bid-Opportunities. THE PAYMENT OF PREVAILING WAGES IS REQUIRED ON THIS PROJECT. The DBE Contract Goal is XX percent. Bidders are advised that, as required by federal law, the City of Modesto is implementing Disadvantaged Business Enterprise requirements. Section 14, "STATE AND FEDERAL REQUIREMENTS & PROVISIONS," under Subsection titled "Disadvantaged Business Enterprises (DBE)" of the special provisions cover the DBE requirements. THIS PROJECT IS SUBJECT TO THE "BUY AMERICA" PROVISIONS OF THE SURFACE TRANSPORTATION ASSISTANCE ACT OF 1982 AS AMENDED BY THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991. Pursuant to Section 1770 et seq. of the Labor Code of the State of California, the Director of Industrial Relations of the State of California has ascertained the general prevailing rate of hourly wages and rates for legal holidays and overtime work in the locality where this work is to be performed, for each craft or type of worker or mechanic needed to execute the contract which will be awarded the successful bidder. The prevailing rates are on file in the office of the City Clerk, 1010 Tenth Street, Modesto, California, and are available to any interested party on request. Pursuant to Section 1725.5 of the Labor Code of the State of California, the Contractor must register with the Department of Industrial Relations. Pursuant to Section 1771.4 of the Labor Code of the State of California, this project is subject to compliance monitoring and enforcement of the Department of Industrial Relations. It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all laborers and mechanics employed by them in the execution of the contract. The U.S. Department of Transportation (DOT) provides a toll-free Hotline service to report bid rigging activities. Bid rigging activities can be reported Monday through Friday, between 8:00 am and 5:00 pm, Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion or other fraudulent activities should use the hotline to report these activities. The hotline is part of the DOT's continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and call anonymity will be respected. Bidder's attention is hereby called to the nondiscrimination clause contained in Section 7 of the General Provisions of the City Standard Specifications. The Bidder shall check the project listing on the City's website the day prior to bid opening to obtain any addenda information. Completion of the addenda acknowledgement section of the Bid Form shall be evidence that the bidder has obtained this information and that the bid is based on any changes contained therein. Bidders may be required to furnish a sworn statement of their financial responsibility, technical ability and experience before award is made to any particular bidders. Before entering into a contract for the work, Contractors shall be licensed in accordance with the provisions of Sections 7000 through 7145, inclusive, of the Business and Professions Code of the State of California. The successful Contractor will be required to furnish 2 acceptable surety bonds: one for Perform¬ance and the other for Payment. Each bond is to be executed in a sum equal to 100 percent of the contract price. City staff will verify that the certificate of authority of the insurer has not been surrendered, revoked, canceled, annulled, or suspended. In the event that the certificate of authority has been surrendered, revoked, canceled, annulled, or suspended, a renewed certificate of authority shall be submitted within 10 calendar days of the insurer's receipt of the renewed certificate. The City of Modesto has established a mandatory prequalification project site visit to meet with City staff to discuss this Request for Qualifications (RFQ) on April 24, 2026, April 28, 2026, or May 7, 2026. Each Contractor interested in submitting Statements of Qualifications (SOQ) for this project shall schedule with the Design Project Manager for the dates indicated, in 1-hour time slots, between the hours of 9:00 am to 4:00 pm. The design project manager is: Max Navarro manavarro@modestogov.com Ph: 209-571-5116 Any Contractor NOT scheduling and attending the Mandatory Prequalification Project Site Visit will be deemed non-responsive and NOT allowed to submit a Statement of Qualifications (SOQ) for this project. Any requests for clarifications, corrections or modifications of this Request for Qualifications (RFQ) shall be submitted through the Question & Answer section of this Request for Qualifications (RFQ) on the City's OpenGov Procurement portal: https://procurement.opengov.com/portal/modestogov/projects/249014 by 4:00 p.m., no later than 7 business days prior to the bid opening. The successful Contractor will be required to obtain a business license from the City of Modesto and pay related fees and taxes. The successful bidder must possess a valid Class "A," "B," or "C-10" California Contractor's License at the time of the award of this contract, to complete the Work as described. Each Statement of Qualifications (SOQ) shall be submitted pursuant to the specific instructions and requirements for preparing and submitting a Statement of Qualifications (SOQ) available through the OpenGov Procurement Portal. If you wish to be considered for this project, please electronically submit your Statements of Qualifications through the City's OpenGov Procurement portal before 11:00 am on Tuesday, May 19, 2026. Statements of Qualifications received in any other format will not be accepted. The City will evaluate all submittals, but this Request for Qualifications (RFQ) does not commit the City of Modesto to approve an agreement, to pay for any costs incurred in preparation or presentation of a Statements of Qualifications, or to procure an agreement for services. The City reserves the right to: Make the selection based on its sole discretion. Accept or reject any and all Statements of Qualifications, or any item or part thereof, or to waive any informalities or irregularities. Withdraw this Request for Qualifications (RFQ) at any time without prior notice, and the City makes no representations that any agreement will be approved with any firm responding to this Make the selection based on its sole discretion. Issue subsequent Request for Qualifications (RFQ). Postpone Statements of Qualifications opening for its own convenience. Approve or disapprove the use of particular subconsultant Negotiate with any, all, or none of the firms submitting a Statements of Qualifications. Enter into an agreement with another firm in the event the originally selected Proposer defaults or fails to execute an agreement with the City. The City reserves the right to reject any or all bids or to waive any informalities or minor irregularities in a bid. No bidder may withdraw his bid for a period of 90 days after the date set for the opening thereof. Bidders shall review the City's insurance coverage requirements with its insurance agent and verify that Bidder's insurance coverage meets or exceeds the City's requirements as stated in the Contract Documents. Bidders are notified that in case of either default in signing and returning the 2 copies of the contract and "Subcontracting Request" Form within 5 business days after having received Notice of Intent to Award the contract, or in case of default in obtaining and delivering fully executed and valid bonds and insurance acceptable to the City within 5 business days after having received Notice of Award, the proceeds of the check or bond accompanying this bid shall become the property of the City of Modesto.
