PART A - NOTICE INVITING BIDS FOR AT-GRADE CROSSING SAFETY IMPROVEMENTS N. SAN ANTONIO BLVD FEDERAL PROJECT NO. STPLR 7500(238) SGVCOG CONTRACT NO. 25-34 Located in: the County of Los Angeles & City of Pomona The San Gabriel Valley Council of Governments, (as "AGENCY"), invites bids for the above-stated project (as "PROJECT") and will receive such bids via the AGENY's electronic bid management system, Planetbids, up to but not later than 2:00 PM PST, on March 12, 2026 at which time they will be publicly opened. Project Location and Description: The PROJECT is located in the City of Pomona crossing the Union Pacific Railroad (UPRR) Los Angeles/Alhambra Subdivisions at UPRR milepost (MP) 32.80/MP 515.20 respectively. The project will include roadway and general improvements for both vehicular and pedestrian traffic along N. San Antonio Blvd in and around the UPRR tracks. This project also includes roadway improvements on E. 1st Street which runs parallel to and south of the UPRR tracks. Project Limits: From intersection of N. San Antonio Blvd and E. 1st Street along the center line 200' north and approximately 55' south on N. San Antonio Blvd encompassing full street width and sidewalks, and 128' west and 156' east on E. 1st Street. The project also includes working within the UPRR right-of-way at the grade crossing. See Part E-General Provisions, Section 2.8, Right-of-Way and Flagging Costs for requirements concerning railroad right-of-way access and coordination. Project Scope Items: The project work includes, but is not limited to the construction of typical street features such as curb, gutter, sidewalk, pedestrian crossing features including sidewalk ramps, stairs, railing and gates, pedestrian ramps; roadway structural section and roadway reprofiling, hardscape and other ancillary site improvements, miscellaneous utility protection and/or relocation, storm drain modifications, relocation of signs, signing and striping, traffic signal modifications, installation of vehicular and pedestrian railroad safety equipment. Temporary work consists of providing traffic control features and storm water quality BMPs. Permits will also be required for this work. Contractor shall coordinate with Union Pacific Railroad (UPRR) for congruent work efforts. See Parts E, F and G for additional details. Special requirements: A significant amount of work for this project will be adjacent to existing active railroad tracks. This work will require coordination with Union Pacific Railroad (UPRR) including obtaining right-of-entry permit and obtaining an agreement with UPRR (See Part E-General Provisions, Section 2.8, Right-of-Way and Flagging Costs for requirements concerning railroad right-of-way access and coordination). All work associated with this project will be done while maintaining rail operations. All staff working on this project including subcontractors, vendors, supervisors, inspectors, and any other staff associated with the project that will be entering the railroad right-of-way shall obtain a Roadway Worker Protection training certification prior to entering the railroad right-of-way. With high volume traffic throughout the day, various constraints shall be adhered to and all work will require phasing and sequencing to maintain business operations and vehicular, truck, and pedestrian access. Contractor must comply with all environmental mitigation measures. Project Sequencing: The work shall be sequenced between the contractor and UPRR. Portions of the work that will be completed by UPRR are shown on plan sheet 16. UPRR must complete certain portions of their scope prior to the contractor mobilizing. The contractor must also complete certain items in order for UPRR to perform their work. The sequence of work shall be as outlined in Section 6-1. Contractor shall possess a valid California Contractor's Class A license. Federal and State Requirements: This is a federal project under Davis-Bacon regulations; state and federal wage rates will be enforced and the higher of these two minimum prevailing wages will apply. The latest federal wages are in Part E, Attachment 4 and found here: https://sam.gov/wage-determinations. The applicable prevailing wage determinations may require an increase to the prevailing wage rates for specific classifications. All person performing the work shall be paid not less than the General Prevailing Wage Determination prepared by the Director of Industrial Relations pursuant to the California Labor Code (Part 7, chapter 1, Article 2, Sections 1770). The AGENCY's Labor Compliance Program will be enforced. Contractors and subcontractors who bid or work on this PROJECT must register and pay an annual fee to the Department of Industrial Relations. This project must comply with 40 CFR Part 247 "Comprehensive Procurement Guideline for Products Containing Recovered Materials." This guideline designates items that are or can be made with recovered materials and whose procurement by procuring agencies will carry out the objectives of section 6002 of Resource Conservation and Recovery Act of 1976. EPA's recommended practices with respect to the procurement of specific designated items are found in the companion Recovered Materials Advisory Notice(s). Federal and State Contractor Eligibility Check: Prior to awarding a contract, contractor verification will be performed through the California Department of Industrial Relations at http://www.cslb.ca.gov, http://efiling.dir.ca.gov, and eligibility at http://www.dir.ca.gov/dsle/debar.html and excluded parties list at the federal System for Award Management (SAM) website http://www.sam.gov. California Air Resources Board: The California Air Resources Board ("CARB") - implemented amendments to the In-Use Off-Road Diesel-Fueled Fleets Regulations ("Regulation") which are effective on January 1, 2024 and apply broadly to all self-propelled off road diesel vehicles 25 horsepower or greater and other forms of equipment used in California. A copy of the Regulation is available at https://ww2.arb.ca.gov/sites/default/files/barcu/regact/2022/off-roaddiesel/appa-1.pdf. Bidders are required to comply with all CARB and Regulation requirements, including, without limitation, all applicable sections of the Regulation, as codified in Title 13 of the California Code of Regulations section 2449 et seq. throughout the duration of the Project. Bidders must provide, with their Bid, copies of Bidder's and all listed subcontractors' most recent, valid Certificate of Reported Compliance ("CRC") issued by CARB. Failure to provide valid CRCs as required herein may render the Bid non-responsive. Local Requirements: Prior to contract execution, the contractor and his/her subcontractors shall obtain a local City business license and encroachment permit from the City of Pomona. Other permits may be required by applicable third parties such as UPRR and other local agencies. Contractor will also be required to obtain an LA County Rider Permit. In accordance with provisions of Section 3300 of the California Public Contract Code, Contractor shall possess a valid Class A California Contractor's License or other appropriate license classification under the State Contracting Code at the time the contract is bid and shall remain valid to project completion. Failure to possess such license may render the bid nonresponsive. The successful bidder will be required to obtain a City Encroachment Permit to do work in public right-of-way, issued at no fee for the project. Buy America Requirements Apply: The Project is subject to Buy America, Bidders must submit a Buy America Certificate in accordance with the Federal Requirements under Title 49, Code of Federal Regulations, Part 661 and Caltrans LAPM (See Part E, Attachment 7). Bid Submittals: Bids must be prepared on the approved Bid forms (Part C) in conformance with the Instructions to Bidders and submitted via Planetbids. No modification to the bid forms is permitted. Bid Guarantee: Each bid must be accompanied by cash, certified check, cashier's check, or bidder's bond made payable to the AGENCY or issued by a surety admitted to do business in California, for an amount equal to at least ten percent (10%) of the amount of bid. Such a guarantee will be forfeited to AGENCY should the bidder to whom the contract is awarded fail to enter into the contract. The AGENCY reserves the right to reject any and all bids and to waive any minor irregularities in the bid documents. Bidders may not withdraw their bid for a period of one hundred eighty (180) days after the bid opening date. All bids shall remain valid for one hundred and eighty (180) days from the date bids are due. The AGENCY reserves the right to reject any or all bids, to waive any minor irregularity and to take all bids under advisement for a period not to exceed one hundred and eighty (180) days or such further period as the Bidders may agree to in writing. The award of the contract, if it is awarded, will be to the lowest responsive bidder complying with the Notice Inviting Bids, Instructions to Bidders, and the Information for Bidders.
