NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City of Mt. Shasta Planning Commission will conduct a public hearing at 5:30 PM on Tuesday, March 17, 2026, at the ‘Upper Lodge’ at Mt. Shasta City Park, 1315 Nixon Road, Mt. Shasta, CA 96067, to discuss a request from DM5 LLC for approval of a subdivision subject to the provisions of the Davis-Stirling Common Interest Development Act (Title 6, Part 4, Division 2 of the California Civil Code); said subdivision is for four (4) condominiums, as that term is defined in California Civil Code Section 4125, and is created by a Condominium Plan pursuant to California Civil Code Section 4120(b) (formerly Section 1351(e)), located at 809 Carmen Drive, Mt. Shasta, CA 96067. This project has been determined not to be subject to the California Environmental Quality Act (CEQA) pursuant to Section 15315: Minor Land Divisions. The Planning Commission will consider the recommended environmental determination and hold a public hearing on whether to approve, conditionally approve, or deny the project described in this notice. All interested parties are encouraged and invited to submit written comments regarding the proposed actions or be present at the public hearing to be heard regarding the actions to be considered. To ensure consideration by the Commission, all written material concerning the proposed project should be submitted to Kim Fowler, Planning Director, via email at kfowler@mtshastaca.gov or by mail to 305 N. Mt. Shasta Blvd, Mt. Shasta, California, as soon as possible but no later than three days prior to the hearing. Please note that any challenge of the proposed action in court may be limited to addressing only those issues raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing. A copy of the staff report and all attachments will be posted on the City of Mt. Shasta website at www.mtshastaca.gov and will be available for review at Mt. Shasta City Hall, 305 N. Mt. Shasta Blvd. Mt. Shasta, CA 96067 at least 72 hours prior to the hearing. The City of Mt. Shasta does not discriminate on the basis of race, color, national origin, sex, sexual orientation, gender identity, age, religion, or disability.
