NOTICE OF PROPOSED ADOPTION OF ORDINANCE NO. 2009
PLEASE TAKE NOTICE that on March 9, 2026, at 6:00 p.m. in the Council Chambers, Upland City Hall, 460 North Euclid Avenue, Upland, California, the City Council of the City of Upland shall consider the adoption of Ordinance No . 2009, entitled “An Ordinance of the City Council of the City of Upland, California Amending Chapter 17.37 of the Upland Municipal Code Relating to Accessory Dwelling Units and Junior Accessory Dwelling Units and Finding the Action to be Statutorily Exempt from CEQA under Public Resources Code §21080.17” The aforementioned ordinance was introduced for first reading on February 23, 2026 by the City Council. Ordinance No. 2009 would amend and restate Upland Municipal Code (“UMC”) chapter 17.37, relating to accessory dwelling units (“ADUs”) and junior accessory dwelling units (“JADUs”), to comply with revised state law requirements. The revisions include the following.
First, Ordinance No. 2009 would update local regulations of ADUs to include the following changes: (1) amend 17.37.030 to remove the definition of “attached ADU” and “detached ADU”, and to include “multifamily dwellings” in the definition of “primary dwelling”; (2) amend 17.37.060 to remove deed restriction requirements for ADUs; (3) amend 17.37.070 to define building separation requirements for ADUs; (4) amend 17.37.070 to clarify parking requirements for ADUs; (5) amend 17.37.070 to update landscape requirements; and (6) amend 17.37.080 to update connection requirements for utilities.
Second, Ordinance No. 2009 would update local regulations of JADUs to include the following changes: (1) amend 17.37.060 to provide fire sprinkler requirements for JADUs; (2) amend 17.37.060 to clarify owner-occupancy requirements for JADUs consistent with state law; (3) amend 17.37.080 to include connection requirements for utilities for JADUs.
Finally, Ordinance No. 2009 would update local regulations applicable to both ADUs and JADUs to include the following changes: (1) amend 17.37.040 to provide that all ADUs and JADUs require an ADU permit and building permit under the Chapter; (2) amend 17.37.040 to define the process and timing of ADU and JADU applications, including application completeness, deadlines to approve or deny applications, appeal procedures, and clarifying that no discretionary review or hearing will be held on an application; (3) amend 17.37.050 to clarify the number and type of ADUs and JADUs permitted on certain lots; (4) adds section 17.37.050, “Classes,” to the Chapter; (5) redefine “Building Permit Only” ADUs and JADUs under 17.37.040 as “Class 1” (Statutorily Regulated) ADUs and JADUs under 17.37.050; (5) redefine “ADU Permit” ADUs and JADUs under 17.37.040 as “Class 2” (Locally Regulated) ADUs and JADUs under 17.37.050; (6) amend 17.37.050 to remove rent reporting requirements; (7) amend 17.37.060 regarding measure of building height; (7) amend 17.37.060 updating certificate of occupancy timing; (8) amend 17.37.080 to update impact fee requirements; (9) amend 17.37.080 to update school fee requirements; (10) clarify that applicable square footage requirements are measured as “interior livable space” throughout the Chapter; and (10) update and amend references to Sections of the Chapter to be internally consistent.
A certified copy of the entirety of the text of Ordinance No. 2009, together with the Code to be adopted thereby, is available in the office of the City Clerk, Upland City Hall, 460 North Euclid Avenue, Upland, California, and is open for public inspection at that location.
