PUBLIC NOTICE GOVERNOR CERTIFIES BARSTOW INTERNATIONAL GATEWAY PROJECT UN DER CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) JUDICIAL STREAM LIMING (SENATE BILL 149) The Barstow International Gateway Project has been certified by the Governor as an infrastructure project under Senate Bill No. 149. The project applicant is the BNSF Railway Company. This requires the City of Barstow, as lead agency under the California Environmental Quality Act (CEQA), to issue a public notice of the certification using the language below: THE APPLICANT HAS ELECTED TO PROCEED UNDER CHAPTER 7 (COMMENCING WITH SECTION 21189.80) OF DIVISION 13 OF THE PUBLIC RESOURCES CODE, WHICH PROVIDES, AMONG OTHER THINGS, THAT ANY JUDICIAL ACTION CHAL LENGING THE CERTIFICATION OF THE ENVIRONMENTAL IMPACT REPORT (EIR) OR THE APPROVAL OF THE PROJECT DESCRIBED IN THE EIR IS SUBJECT TO THE PROCEDURES SET FORTH IN SECTIONS 21189.85 AND 21189.86 OF THE PUBLIC RESOURCES CODE. A COPY OF CHAPTER 7 (COMMENCING WITH SECTION 21189.80) OF DIVISION 13 OF THE PUBLIC RESOURCES CODE IS INCLUDED BE LOW.
