CITY OF OAKLAND NOTICE OF PUBLIC HEARING ON PLANNING CODE AMENDMENTS TO UPDATE ACCESSORY DWELLING UNIT REGULATIONS AND PROVIDE WRITTEN FINDINGS, REVISE STANDARDS FOR NONCONFORMING ACTIVITIES, REMOVE APPLICABILITY OF DISCRETIONARY STANDARDS TO MINISTERIAL DESIGN REVIEW IN S-10 ZONE, PERMIT RECREATIONAL ASSEMBLY ACTIVITIES IN D-WS-9 ZONE, REVISE FRONT SETBACK IN D-CO-2 ZONE, REMOVE A REVIEW DEADLINE FROM DEVELOPMENT AGREEMENT PROCEDURE IN SECTION 17.138.030, REVISE UTILITY SCREENING STANDARDS IN SECTION 17.124.045, AND INCORPORATE CONFORMING AND CLERICAL REVISIONS Notice is hereby given that the Oakland Planning Commission will hold a public hearing to incorporate various conforming Planning Code changes to eliminate errors and inconsistencies, and to update Accessory Unit Dwelling regulations for consistency with state law and provide written findings pursuant to Government Code 66326(b) on Wednesday, May 20, 2026, at 3:00 PM., in Hearing Room 1 at Oakland City Hall, One Frank H. Ogawa Plaza, Oakland, CA 94612, where the Planning Commission will review proposed changes to the Planning Code, receive public comments, and engage in a public discussion prior to making a recommendation to City Council. Project Description: Planning Code amendments to (1) update Accessory Dwelling Unit regulations for consistency with state law and provide written findings pursuant to Government Code 66326(b); (2) revise discontinuance standards for nonconforming activities; (3) remove applicability of S-10 Scenic Route Combining Zone discretionary standards to ministerial design review; (4) permit Recreational Assembly Activities in the Wood Street D-WS-9 Zone; (5) revise minimum front setback in D-C0-2 Zone; (6) remove a review deadline from Development Agreement Procedure in Section 17.138.030; (7) revise utility screening standards in Section 17.124.045; and (8) incorporate various conforming and clerical revisions. The Draft Planning Code Amendments and explanatory materials will be available online, generally by 5:00 p.m. the Friday before the meeting, at www.oaklandca.gov/PlanningCommission.
