NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Butte County Department of Public Works 7 County Center Drive Oroville, CA 95965 (530) 552-5710 The Butte County Department of Development Services will submit a request to the Housing and Community Development (HCD), Division of Federal Financial Assistance, Disaster Recovery Office, for the release of CDBG-DR funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the Butte County Roads Rehabilitation Project. The purpose of this project is to rehabilitate or repair the following 33 roads under the Magalia Local Roads Repair Project (33): Compton Dr, Lakeridge Ct, Achilles Ct, Bentley Ct, Catham Ct, Chestnut Cir, Citadel Way, Dade Ct, Decatur Dr, Drexel Dr, Flint Ct, Glendale Ct, Hobert Ct, Huron Ct, Jarvis Cir, Joplin Ct, Lamar Ct, Loyola Ct, Marin Ct, Menlo Ct, Molinari Ct, Norwich Cir, Pineland Cir, Purdue Ct, Rutgers Ct, Scripps Ct, Siena Ct, Simonson Ct, Staten Ct, Temple Cir, Zuckerman Ct, Providence Ct, Tulsa Ct These roads were severely damaged during Camp Fire recovery efforts, primarily due to large trucks accessing multiple recovery sites. This project will repair approximately 6.23 miles of damaged road. The project's scope of work includes repairing the roadways, returning them to their pre-disaster design and functionality. The repairs will adhere to current engineering standards with a 20-year design life. The Butte County Roads Rehabilitation Project was awarded funding on February 28, 2024. The award amount for the Magalia Local Roads Repair Project (33) is $ 2,245,340 under the Community Development Block Grant Disaster Recovery (CDBG-DR) program from the Department of Housing and Community Development Division of Federal Financial Assistance (2018 CDBG-DR Infrastructure Program, Contract No. 18DRINFRA-18001). The proposed activities for this project have been determined to have no significant environmental impact. An Environmental Review for Activity/ Project that is Categorically Excluded Subject to Section 58.5 (ERA/CEST) documenting the environmental determinations is on file at the Butte County Department of Public Works Office, located at 7 County Center Drive, Oroville, CA 95965. It is available for review weekdays between 8:00 A.M. and 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the Environmental Review Record (ERR) to the Butte County Department of Public Works, located at 7 County Center Drive, Oroville, CA 95965. All comments received by 5:00 P.M. on May 11, 2026 will be considered by Butte County prior to authorizing submission of the request for release of funds. ENVIRONMENTAL CERTIFICATION The Butte County Department of Development Services certifies to the HCD Sacramento Office that Paula Daneluk, in her capacity as Director, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities related to the environmental review process, and that these responsibilities have been satisfied. Approval of this certification by the HCD Sacramento Office satisfies its responsibilities under NEPA and related laws and authorities, enabling the Butte County Department of Development Services to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HCD Sacramento Office will accept objections to its release of fund and the Butte County Department of Development Services' certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Butte County Department of Development Services; (b) the Butte County Department of Development Services has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HCD Sacramento Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Paula Daneluk, Director, Butte County Development Services Note: The seven or ten-day public comment periods are the minimum time periods required by regulation prior to submission of a Request for Release of Funds and Certification [form HUD-7015.15] to HUD/State. The Responsible Entity may choose to allow a longer comment period. The fifteen-day objection period following submission of the request is a statutory requirement. The objection period follows the submission date specified in the Notice or the actual date of receipt by HUD/State, whichever is later. Following completion of the comment period recipients may FAX the form HUD-7015.15 to HUD/State together with a copy of the public notice and a cover letter stating whether comments were received and, if so, how the recipient responded to the comment. The Request for Release of Funds and Certification should not be submitted before the recipient has responded. If the request is sent by FAX, the original signed form should be mailed to HUD/State. The date of receipt by FAX will be counted as the submission date. However, HUD will not issue the 7015.16 "Authority to Use Grant Funds" until after the original signed form is received.
