CITY OF SAN RAFAEL NOTICE OF PUBLIC HEARING BEFORE THE SAN RAFAEL CITY COUNCIL On May 4, 2026 the San Rafael City Council will meet to consider a request to amend the Development Agreement for the BioMarin San Rafael Campus at 770 Lindaro Street/999 Third Street (formerly San Rafael Corporate Center) (Ordinance 1982) to modify public access requirements and ancillary parking obligations in exchange for continued public benefits (Project No. PLAN25-132). At its meeting on April 14, 2026, the Planning Commission reviewed the proposed amendments and voted 5-0 to recommend that the City Council approve the First Amendment to Development Agreement; APN(s): 013-021-34, 35, 50, 51, 52, 53, 54, 55, and 011-265-02 DATE/TIME: Monday, May 4, 2026 at 6:00 P.M. LOCATION: City Council Chambers, City Hall, 1400 Fifth Avenue, San Rafael, CA 94901 ENVIRONMENTAL REVIEW: The project has been found to be exempt from environmental review pursuant to CEQA Guidelines Section 15061(b)(3) (General Rule). The proposed Amendment involves administrative modifications to public access and parking requirements and does not authorize any new development, changes to building envelopes, or increases in density or intensity beyond what was previously approved and analyzed in the Final EIR for the 999 3rd Street project (certified 2020). WHAT WILL HAPPEN: Staff will make a presentation on this item, and the City Council will then open the public hearing. The Applicant will also be able to make a presentation, and members of the public may also provide oral comments/questions related to the topic as well. Then the City Council will close the public hearing, deliberate and may take an action on the request.
