Initiative Measure to End South El Monte's Commercial Cannabis Operations Regulatory Program
If approved by South El Monte voters, this measure will end/terminate the South El Monte's commercial cannabis permitting program ("Program") which at present allows the City of South El Monte (‘“City”) to issue a maximum of three (3) commercial cannabis business operating permits Citywide. The Program was originally approved by South El Monte voters as Measure CM at the City's November 8, 2022 General Municipal Election, and is codified in the South El Monte Municipal Code as Chapter 5.26 (Commercial Cannabis Operations Regulatory Program). Approval of this measure would repeal Chapter 5.26 rendering all variety of cannabis business operations in the City prohibited, except to the limited extent State law allows certain cannabis related activities/operations and the regulation of such State-allowed activities/operations is preempted by State law and, as a result, beyond the City's regulatory reach.
Notice of Intent to Circulate PetitionNotice is hereby given by the person whose name appears hereon of the intention to circulate the petition within the City of South El Monte to repeal and revoke Measure CM, a measure that allows up to three (3) marijuana and cannabis businesses to operate in the City of South El Monte.
The amendment to the existing ordinance would remove the use and operation of Marijuana and Cannabis businesses and legally prohibit other marijuana and cannabis uses and all commercial marijuana and cannabis activity within the City of South El Monte subject to regulations set forth in the South El Monte Municipal Code. The title and statement of the reasons for the proposed action as contemplated in the petition as follows:
