NOTICETOWN OF SILVER CLIFFORDINANCE NO. 01-2026AN ORDINANCE TO AMEND SEC. 10-9-30 OF THE SILVER CLIFF MUNICIPAL CODE WITH RESPECT TO EXCESSIVE NOISE AND TO AMEND SEC. 10-9-60 OF THE SILVER CLIFF MUNICIPAL CODE WITH RESPECT TO PENALTIES THEREFOR.WHEREAS, the Town of Silver Cliff has adopted standards outlining unlawful acts related to excessive noise in the Silver Cliff Municipal Code within Chapter 9 of Title 10 of the Code; and,WHEREAS, upon review of the regulations contained therein, it appears necessary to the Board of Trustees of the Town to amend such regulations to better define the terms of certain noise violations; and,WHEREAS, it further appears necessary to the Board of Trustees of the Town to amend the penalties for violations of noise provisions in the Code to better reflect the importance of these provisions and the severity of such violations on the residents of the Town of Silver Cliff; and,WHEREAS, the Town elects to amend the noise code provisions, and penalties for violations of such provisions, as outlined herein. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF SILVER CLIFF, COLORADO AS FOLLOWS:Section 1: Sec. 10-9-30 of the Municipal Code is amended as follows (deletions are in strike-through; additions are double-underlined):Sec. 10-9-30. Unlawful acts.(a) It is unlawful for any person to make, cause to be made, or to permit any unreasonable noise upon any premises or within any vehicle owned, possessed or operated or controlled by such person. (b) Law enforcement personnel, including code enforcement officials, may, in the determination of whether a noise is unreasonable, consider factors that include, but are not limited to: (1) The time of day, with a presumption that loud noise between the hours of 10:00 p.m. and 5:00 a.m., except as outlined herein, is unreasonable; (2) The size of any gathering of persons creating or contributing to the noise; (3) The presence or absence of noise amplification equipment; (4) Any other factors tending to show the magnitude and/or disruptive effect of the noise. (c) With regard to vehicles, the determination of unreasonable noise, in addition to the previously stated factors shall include, but not limited to: (1) The continuous or repeated sounding of any horn, alarm or signal device of a vehicle, except where an actual emergency or danger exists. (2) The operation of any vehicle in a manner that causes unreasonable noise.(d) With regard to amplified outdoor music, such music at a commercial establishment or event authorized by the Town is not permitted during the hours of 9:00 p.m. through 9:00 a.m. Sunday through Thursday or during the hours 11:00 p.m. through 9:00 a.m. on Friday, Saturday or on Federal or State holidays.
