Poli Mortgage Group, Inc., et al.
TO: any former stockholders, officers, creditors and any other persons claiming any interest in Poli Mortgage Group, Inc., a dissolved domestic corporation formerly having a usual place of business in Norwood, Norfolk County, in said Commonwealth; and Taylor, Bean & Whitaker
Mortgage Corporation, a defunct foreign corporation formerly having a usual place of business in Winter Park, in the State of Florida, or their heirs, devises, legal representatives, successors or assigns.
You are hereby notified that a complaint has been filed by the above-named plaintiff in which you are named as an interested party. This complaint concerns property in Newton, Middlesex County, and said Commonwealth, being known as and numbered 49 Carlson Avenue, Newton Centre, and is described in a deed dated September 17, 1999 and recorded with the Middlesex County (South) Registry of Deeds (Registry) in Book 30670, Page 572 (the Property); title to said property is clouded by an improperly assigned mortgage. The owner of the property executed a mortgage in favor of defendant Poli Mortgage Group, Inc. (Poli) on December 23, 2003, and as recorded with the Registry on December 31, 2003 in Book 41711, Page 311 (Mortgage). Poli purportedly assigned the Mortgage to defendant Taylor, Bean & Whitaker Mortgage Corporation (Taylor) by assignment ("First Assignment") dated December 23, 2003 and recorded with the Registry on December 31, 2003 in Book 41711, Page 328. Plaintiff alleges the First Assignment did not include recording information for the underlying Mortgage but only listed the date the Mortgage was executed. Taylor purportedly assigned the Mortgage to plaintiff JPMorgan Chase Bank, N.A. by assignment ("Second Assignment") dated November 2, 2021 and recorded with the Registry on November 8, 2021 in Book 79098, Page 466. Plaintiff alleges the Second Assignment was erroneously signed by one Latonya Odom as Vice President of Taylor, although Latonya Odom was in face Vice President of the plaintiff. Plaintiff alleges that Ms. Odom intended to execute the Second Assignment on behalf of Taylor acting as attorney in fact for that corporation. Plaintiff claims that, owing to the infirmities in the First Assignment and Second Assignment, it is not now the valid holder of the Mortgage as the parties intended. Plaintiff seeks an equitable order of assignment which would give the plaintiff record title to the Mortgage on the Property, and declaratory judgment that the any interests the defendants have in the Mortgage are held in trust for the benefit of the plaintiff.

If you intend to make any defense, you are hereby required to serve upon the plaintiff's attorney, Tracy A. Kish, Esq. of Korde & Associates, P.C., whose address is 900 Chelmsford Street, Suite 3102, Lowell, Massachusetts 01851, an answer to the complaint on or before the twenty-fifth day of May, 2026, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.
If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or
occurrence that is the subject matter of the plaintiff's claim, or you will thereafter be barred from making such claim in any other action.
It is ORDERED that notice be given by publishing a copy of this notice once in The Boston Globe, a newspaper of general circulation in the Commonwealth of Massachusetts at least thirty days before the twenty-fifth day of May, 2026.
It is FURTHER ORDERED that notice be given by publishing a copy of this notice once in the Orlando Sentinel, a newspaper of general circulation in Winter Park, Florida at least thirty days before the twenty-fifth day of May, 2026.
