These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of West Palm Beach.
REQUEST FOR RELEASE OF FUNDS
On or about June 9, 2026, the City of West Palm Beach will submit a request to the Department of Housing and Urban Development (HUD) Miami, for the release of the HOME Investment Partnerships American Rescue Plan Program (HOME-ARP) funds under Section 3205 of the American Rescue Plan Act of 2021 (Public Law 117-2) and Economic Development Initiative, Community Project Funding under the Consolidated Appropriations Act, 2024 (Public Law 118-42) to undertake a project known as 1400 Henrietta Avenue Development. The project will be a multifamily affordable rental community targeting families and individuals at or below 80% of the area median income (AMI). This project will consist of 18 units, comprised of 6- one bedroom, 6- two bedroom and 6- three bedroom units for individuals and families at risk of homelessness. The total estimated project cost is $6,440,158 (including non-HUD funding sources). The project will be located at 1400 Henrietta Avenue, West Palm Beach, Florida 33407.
FINDING OF NO SIGNIFICANT IMPACT
The City of West Palm Beach has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of West Palm Beach, Department of Housing Community and Development located at 401 Clematis Street 3rd Floor, West Palm Beach, Florida 33401 and may be examined or copied on weekdays 8:00 A.M.- 5:00 P.M. The ERR will also be made available to the public for review electronically. Please submit your request by email to HCD@wpb.org.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the Environmental Review Record (ERR) to the City of West Palm Beach Department of Housing Community and Development. All comments received by June 8, 2026, will be considered by the City of West Palm Beach prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of West Palm Beach certifies to the U.S. Department of Housing and Urban Development (HUD) Miami Field Office, that Keith A. James in his capacity as the Mayor of the City of West Palm Beach consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of West Palm Beach to use Program funds.
OBJECTION TO RELEASE FUNDS
HUD will accept objections to its release of fund and the City of West Palm Beach's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of West Palm Beach; (b) the City of West Palm Beach has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development (HUD) Miami Field Office at CPDRROFMIA@hud.gov. Potential objectors should contact the U.S. Department of Housing and Urban Development (HUD) Miami Field Office to verify the actual last day of the objection period.
