Resolution for the
publication, hearing and sale of two Ferris Lawn Mowers belonging to Cedar Township, Mahaska County
WHEREAS, Cedar Township owns two Ferris Lawn Mowers and is no longer in need of such property for township purposes. They are:
2019 Ferris Lawn Mower 2600 with 607.5 hours (will increase as this mower is currently being utilized), deck size 61 inches;
2014 Ferris Lawn Mower 1500 with 297 hours, deck size 44 inches.
Both mowers are sold as is. Mowers can be viewed on Tuesday, May 12 at 6pm to 8pm at Cedar Township Memorial Cemetery.
WHEREAS, Cedar Township desires to sell said property.
WHEREAS, Iowa Code Section 360.9(2) provides that [a]ny real estate, including improvements thereon, situated within a city, owned by a township and heretofore used for township purposes and which is no longer necessary for township purposes, may be sold by the township trustees at public auction for the best bid.
WHEREAS, Iowa Code Section 360.9(4)(1) requires that sales at public auction shall be made only after the township trustees advertise for bids for such property. Such advertisement shall definitely describe said property and be published by at least one insertion each week for two consecutive weeks in some newspaper having general circulation in the township.
WHEREAS, the trustees desire to accept sealed bids, beginning on May 11, 2026 and ending on May 22, 2026 at 6pm. The top four bidders for each lawn mower will be invited to a public hearing on Wednesday, May 27, 2026 at 7pm where those bidders may increase, but not reduce, their bid.
WHEREAS, Iowa Code Section 360.9(4)(2) provides that the trustees may accept only the best bid received prior to acceptance and may decline to sell if all the bids received are deemed inadequate.
WHEREAS, bids shall be mailed to Cedar Township Clerk, Jennifer Van Zante, 3039 320th St, Fremont, IA 52561.
NOW THEREFORE, BE IT RESOLVED, by the Township Trustees of Cedar Township, Mahaska County, Iowa, that the Township Clerk is hereby authorized and directed to publish notice of hearing to be held at the Cedar Township Fire Station, 701 East Main, Fremont, Iowa on the 27th day of May, 2026.
