A true copy of the Petition is attached hereto and made a part hereof.YOU ARE FURTHER NOTIFIED that the Court has entered an Order setting an ADJUDICATORY HEARING on the merits of the Petition on Monday, June 8, 2026 at 9:00 AM, in the designated Juvenile Courtroom of the Buchanan County Courthouse in Independence, Iowa.YOU ARE HEREBY COMMANDED to appear before the Court at the time and place immediately above stated. You shall bring the child named above with you at that time. If you fail without reasonable cause to appear or to bring the child, you may be proceeded against for contempt of court or the Court may issue an order for your arrest, or both your arrest and the taking into custody of the child.YOU ARE FURTHER NOTIFIED that the child must be represented by an attorney and guardian ad litem, which may be the same person. The court has appointed an attorney and guardian ad litem to represent the child. If the parent has or will retain an attorney to represent the child as attorney and guardian ad litem, that attorney should be notified immediately. If the child is then represented by counsel retained by the parents and the Court determines there is a conflict of interest between the child and his or her parent, guardian or custodian and that retained counsel could not properly represent the child as a result of the conflict, the Court shall appoint other counsel to represent the child and set a hearing to determine payment for attorney fees to be assessed to the parent.YOU ARE FURTHER NOTIFIED that a parent, guardian or custodian in a child in need of assistance proceeding has the right to be represented by counsel at all hearings subsequent to the filing of a Petition. If you wish to privately retain counsel, you should immediately notify the attorney of these proceedings. If you desire representation but you cannot afford to hire an attorney, you should immediately contact the Clerk of the above-named court and request from and file with the Clerk an Application for Appointment of Counsel and Financial Statement. If you are determined to be indigent, the Court may appoint counsel for you. The child's parent is notified that the child's parent may be required to reimburse the state for all of the legal fees and costs attributed to the appointment of counsel for the child's parent.YOU ARE FURTHER NOTIFIED that upon your request, the Clerk shall issue subpoenas requiring the attendance and testimony of witnesses and the production of papers at the adjudicatory hearing.YOU ARE FURTHER NOTIFIED that the adjudicatory hearing may take place without your presence if you fail to appear after reasonable notification. The Iowa Department of Human Services will notify you of the amount of any recommended parental liability for the cost of foster care and there exists an administrative procedure if you object. I.L.K., a child, 12 years of age resides in Buchanan County, Iowa.2. The names and residences of the living parents of the child are as follows: Biological Mother: Morgan Louise Pates, 1767 Otterville Blvd, Independence, IA 50644Biological Father: Zacharias James Stowe, 218 Hall St. #5, West Union, IA 52175Stepfather: Gerald Allen Pates,1767 Otterville Blvd, Independence, IA 506443. The child has no other legal guardian.4. The child has no other legal custodian.5. The child has no guardian ad litem.6. The child is a child in need of assistance as defined in Iowa Code Section 232.96A, to wit:232.96A, 232.96A(3)(b): failure of child's parent, guardian, custodian, or other member of the household in which the child resides to exercise a reasonable degree of care in supervising the child.232.96A, 232.96A(6): child is in need of treatment to cure or alleviate serious mental illness or disorder, or emotional damage as evidenced by severe anxiety, depression, withdrawal, or untoward aggressive behavior toward the child's self or others and the child's parent, guardian, or custodian is unwilling to provide such treatment.232.96A, 232.96A(11): Child's parent, guardian, or other custodian for good cause desires to be relieved of the child's care and custody.7.
