NOTICE OF FORFEITURE
OF REAL ESTATE CONTRACT 2870 NE 78th Ave., Ankeny, IA 50021.
TO: Jerry Houk and/or Parties in Possession, 2870 NE 78th Ave., Ankeny, IA 50021.
You and each of you are hereby notified:
(1) The written contract dated August 27, 2019 and executed by Sioux Newberg and Daniel Newberg as Vendor/Seller, and Jerry Houk as Vendees/Buyers, recorded on September 5, 2019 in the office of the Polk County Recorder, recorded as document reference number Book 17616 and Page 665-662, for the sale of the following described real estate:
The North 260 feet of the South 300 feet of the East 98.2 feet of the SE¼ of the SE¼ of Section 30, Township 80 North, Range 23 West of the 5th P.M., Polk County, Iowa, except established roads,
AND
All that part of Lot 4 in the Official Plat of the SW ¼ of the SW ¼ of Section 29, Township 80 North, Range 23 West of the 5th P.M., Polk County, Iowa, lying West of the presently established right-of-way of N.E. 29th Street,
AND
The South 36 feet of Lot 2 in the Official Plat of the SW¼ of the SW¼ of Section 29, Township 80 North, Range 23 West of the 5th P.M., Polk County, Iowa, lying West of the presently established right-of-way of N.E. 29th Street.
EXCEPT that part conveyed to the City of Ankeny by Warranty Deed 13169, Page 276 recorded on August 13, 2009 in the Office of the Polk County Recorder, Polk County, Iowa.

A. The Contract has not been complied with in the following particulars:

2. Failure to pay property taxes pursuant to Section 3 of the Contract. Specifically, taxes due and owing in September of 2025 in the amount of $1,446.00; taxes due and owing in March of 2026 in the amount of $1,389.68 as set forth in paragraph 1. Pursuant to Section 9 of the Contract Seller/Vendor has advanced the payment of taxes and the same are due to Seller/Vendor as set forth in paragraph 1.
B. The contract shall stand forfeited unless the parties in default, within 30 days after the completed service of this notice, shall perform the terms and conditions in default, and in addition pay the reasonable costs of serving this notice.
C. The amount of attorney fees claimed by the Vendors pursuant to Section 656.7 of the Code of Iowa is $ 50.00 (not to exceed $50.00). Payment of the attorney fees is not required to comply with this notice in order to prevent forfeiture.
