ORDINANCE NO. 1-2026
AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF ASBURY, IOWA, CHAPTER 90 “WATER SYSTEMS” REPEALING PROVISIONS INCONSISTENT THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASBURY, IOWA:
SECTION 1. Section 90.08 “Water Rates for Dwelling Units Inside City Limits” is hereby amended to read as follows:
“Water rates for residential dwelling units whose premises are located within the City limits or single-family dwelling units who have signed a pre-annexation agreement shall pay a base rate of $25.00 per month per unit and a use rate as follows:
$0.0290 per cubic foot or $0.00388 per gallon per unit per month
SECTION 2. Section 90.09 “Water Rates for Multi-Family Residential Dwelling Units” is hereby amended to read as follows:
“Multi-Family Residential Dwelling Units located within the City limits shall pay a base rate of $25.00 per unit per month and a use rate as follows:
$0.0290 per cubic foot or $0.00388 per gallon per unit per month
SECTION 3. Section 90.11 “Water Rates for Dwelling Units Outside City Limits” is hereby amended to read as follows:
“Residential dwelling units located outside the City limits shall pay a base rate of $40.00 per unit per month and a use rate as follows:
$0.0320 per cubic foot or $0.004278 per gallon per unit per month
SECTION 4. Section 90.12 “Commercial Water Rates” is hereby amended to read as follows:
“1. Base Rate. Commercial Customers, whether located inside or outside the City limits, shall pay a base rate based upon the size of their water, as determined as follows per month:

8”$1,625.00 per unit
Meter size shall be determined by reference to the Asbury Plumbing Code.”
“2. Use Rate. In addition, commercial customers shall pay a use rate as follows:
A. Inside the City limits
$0.0290 per cubic foot or $0.00388 per gallon per unit per month
B.Outside the City limits
$0.0320 per cubic foot or $0.004278 per gallon per unit per month”
SECTION 4. REPEALER. All ordinance or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 5. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 6. This Ordinance shall be in full force and effect on July 1, 2026.
SECTION 7. The requirements of Section 380.3, Code of Iowa, “a proposed ordinance or amendment must be considered and voted on for passage at two council meetings prior to the meeting at which it is to be finally passed, unless this requirement is suspended by a recorded vote of not less than three-fourths of all of the members of the council. If a proposed ordinance, amendment, or resolution fails to receive sufficient votes for passage at any consideration and vote thereon, the proposed ordinance, amendment, or resolution shall be considered defeated.”
